AN ACT

 

1Regulating unmanned aircraft in Pennsylvania.

2The General Assembly of the Commonwealth of Pennsylvania
3hereby enacts as follows:

4Section 1. Short title.

5This act shall be known and may be cited as the Fourth
6Amendment Protection Act.

7Section 2. Definitions.

8The following words and phrases when used in this act shall
9have the meanings given to them in this section unless the
10context clearly indicates otherwise:

11"Amber Alert System." The system established under section
121(a) of the act of November 24, 2004 (P.L.1270, No.153),
13referred to as the Pennsylvania Amber Alert System Law.

14Section 3. General prohibition.

15A State or local agency, including a law enforcement agency,
16may not utilize an unmanned aircraft system before July 1, 2015.

17Section 4. Permitted use.

1Notwithstanding the prohibition under section 3, an unmanned
2aircraft system may be deployed before July 1, 2015, in an
3emergency or major disaster, when the Amber Alert System is
4activated or during a search and rescue operation if the
5deployment is necessary to protect life, health or property.

6Section 5. Prohibition regarding weaponized aircraft.

7A weaponized unmanned aircraft system may not be deployed or
8its use facilitated by a State or local agency or a member of
9the public. This section does not apply to the Pennsylvania
10National Guard in the following circumstances:

11(1) while utilizing an aircraft system in its facilities
12during training required to maintain readiness for its
13Federal mission;

14(2) when facilitating training for a Department of
15Defense unit at its facilities; or

16(3) when the system is utilized to support the
17Commonwealth for purposes other than law enforcement,
18including damage assessment, traffic assessment, flood stages
19and wildfire assessment.

20Section 20. Effective date.

21This act shall take effect immediately.
