AN ACT
1Amending the act of June 26, 2001 (P.L.755, No.77), entitled "An
2act establishing a special fund and account for money
3received by the Commonwealth from the Master Settlement
4Agreement with tobacco manufacturers; providing for home and
5community-based care, for tobacco use prevention and
6cessation efforts, for Commonwealth universal research
7enhancement, for hospital uncompensated care, for health
8investment insurance, for medical assistance for workers with
9disabilities, for regional biotechnology research centers,
10for the HealthLink Program, for community-based health care
11assistance programs, for PACE reinstatement and PACENET
12expansion, for medical education loan assistance and for
13percentage allocation and appropriation of moneys," in health
14investment, further providing for use of Tobacco Settlement
15Fund.
16The General Assembly of the Commonwealth of Pennsylvania
17hereby enacts as follows:
18Section 1. Section 306(b)(1)(vi) of the act of June 26, 2001
19(P.L.755, No.77), known as the Tobacco Settlement Act, is
20amended to read:
21Section 306. Use of Tobacco Settlement Fund.

23(b) Appropriations.--
1(1) The General Assembly hereby appropriates funds in
2the fund in accordance with the following percentages based
3on actual funds received in each year or upon receipt of the
4final annual payment:

6(vi) Thirty percent, half of which shall be
7allocated for health investment insurance pursuant to
8Chapter 13 and the other half of which shall be allocated
9for the purchase of Medicaid benefits for workers with
10disabilities pursuant to Chapter 15.

12Section 2. This act shall take effect in 60 days.
