AN ACT

 

1Providing for a surveyor's right to enter the land of another to
2perform surveying services.

3The General Assembly of the Commonwealth of Pennsylvania
4hereby enacts as follows:

5Section 1. Short title.

6This act shall be known and may be cited as the Surveyor's
7Right to Enter Act.

8Section 2. Definitions.

9The following words and phrases when used in this act shall
10have the meanings given to them in this section unless the
11context clearly indicates otherwise:

12"Surveyor." An individual registered as a professional land
13surveyor, or agent thereof, under the act of May 23, 1945
14(P.L.913, No.367), known as the Engineer, Land Surveyor and
15Geologist Registration Law.

16Section 3. Right to enter land of another.

17(a) Right of entry.--If necessary to perform surveying
18services relating to the performance of a boundary or 

1topographic land survey, a surveyor may enter upon the land of
2another and use customary equipment and vehicles.

3(b) Identification.--A surveyor shall carry a form of
4identification that indicates the surveyor's registration or
5place of employment. Upon entering the land of another, the
6surveyor shall display the identification to any individual
7requesting to view it.

8(c) Notification.--Prior to conducting a survey, a surveyor
9shall make a good faith effort to notify a landowner whose land
10it is necessary to enter under subsection (a).

11(d) Prohibition.--A surveyor may not enter any of the
12following:

13(1) Land owned by a railroad company located within 50
14feet of a railroad track without first obtaining written
15permission from the railroad company, unless the railroad
16company grants permission to the surveyor, but does not
17provide the surveyor with the written permission form within
18a reasonable amount of time.

19(2) A place used for residence or storage.

20(e) Duty of care.--Nothing in this section may be construed
21as permitting a surveyor to damage the land of another or
22provide immunity from civil liability for the damage.

23Section 4. Effective date.

24This act shall take effect in 60 days.
