1Providing for a siting restriction for assisted living 
2residences, nursing homes and personal care homes.

3The General Assembly of the Commonwealth of Pennsylvania
4hereby enacts as follows:

5Section 1. Short title.

6This act shall be known and may be cited as the Assisted
7Living Residence, Nursing Home and Personal Care Home Siting
8Restriction Act.

9Section 2. Definitions.

10The following words and phrases when used in this act shall
11have the meanings given to them in this section unless the
12context clearly indicates otherwise:

13"Assisted living residence." A premises in which food,
14shelter, personal care, assistance or supervision and
15supplemental health care services are provided for a period
16exceeding 24 hours for four or more adults who are unrelated to
17the operator and who require assistance or supervision in such
18matters as dressing, bathing, diet, financial management,

1evacuation from the residence in the event of an emergency or
2medication prescribed for self-administration.

3"Nursing home." A premises in which nursing care and related
4medical or other health services are provided, for a period
5exceeding 24 hours, for two or more individuals, who are
6unrelated to the operator, who are not acutely ill and not in
7need of hospitalization, but who, because of age, illness,
8disease, injury, convalescence or physical or mental infirmity,
9need that care.

10"Personal care home." A premises in which food, shelter and
11personal assistance or supervision are provided for a period
12exceeding 24 hours for four or more adults who are unrelated to
13the operator, who do not require the services in or of a
14licensed long-term care facility but who do require assistance
15or supervision in such matters as dressing, bathing, diet,
16financial management, evacuation of a residence in the event of
17an emergency or medication prescribed for self-administration.

18Section 3. Assisted living residence, nursing home and personal
19care home siting restriction.

20A municipality shall adopt, amend and implement such
21ordinances as are necessary to prohibit assisted living
22residences, nursing homes and personal care homes in areas of
23the municipality zoned for industrial use.

24Section 4. Effective date.

25This act shall take effect in 60 days.
