AN ACT

 

1Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2Statutes, in registration of vehicles, providing for
3Pennsylvania hunting heritage plates<-; and, in fees, further 
4providing for payments to special funds.

5The General Assembly of the Commonwealth of Pennsylvania
6hereby enacts as follows:

7Section 1. Title 75 of the Pennsylvania Consolidated
8Statutes is amended by adding a section to read:

9§ 1355.1.<- Pennsylvania hunting heritage plate.

10The department, in consultation with the Pennsylvania Game
11Commission, shall design a hunting heritage plate. Upon
12application of any person, accompanied by a fee of $35 which
13shall be in addition to the annual registration fee, the
14department shall issue the plate for a passenger car, motor
15home, trailer or truck with a registered gross weight of not
16more than 10,000 pounds. <-The Pennsylvania Game Commission shall
17receive $15 of each additional fee for this plate for the
18exclusive purposes of promoting hunting and providing hunting

1habitat. <-Fifteen dollars of the fee shall be deposited into the
2Pennsylvania Hunting Heritage Fund and expended as provided in
3section 1905(d) (relating to payments to special funds).

4Section 2. Section 1905 of Title 75 is amended by adding a
5subsection to read:

6§ 1905. Payments to special funds.

8(d) Pennsylvania Hunting Heritage Fund.--Fifteen dollars of 
9each fee received under section 1355.1 (relating to Pennsylvania 
10hunting heritage plate) shall be credited to the Pennsylvania 
11Hunting Heritage Fund, established as follows:

12(1) There is hereby established a special account in the
13State Treasury which shall be known as the Pennsylvania
14Hunting Heritage Fund. The purpose of the Pennsylvania
15Hunting Heritage Fund is to provide funding to nonprofit
16organizations as defined under section 501(c)(3) of the
17Internal Revenue Code of 1986 (Public Law 99-514, 26 U.S.C. §
18501(c)(3) that coordinate the processing and distribution of
19donated wild game from hunters and municipal herd reduction
20sources to Pennsylvania residents through a distribution
21network of food banks in this Commonwealth.

22(2) All moneys in the Pennsylvania Hunting Heritage Fund
23are hereby annually appropriated to the Pennsylvania Game
24Commission and may be expended for the purposes authorized
25under this subsection.

26(3) Estimates of amounts to be expended under this
27subsection shall be submitted to the Governor by the
28Pennsylvania Game Commission for his approval.

29(4) The State Treasurer shall not honor any requisition
30for expenditures by the Pennsylvania Game Commission in

1excess of estimates approved by the Governor or in excess of
2the amount available for the purposes for which the
3requisition was made, whichever is the lesser amount.

4Section <-2 3. This act shall take effect in 60 days.
