AN ACT
1Amending the act of August 9, 1955 (P.L.323, No.130), entitled,
2as amended, "An act relating to counties of the first, third,
3fourth, fifth, sixth, seventh and eighth classes; amending,
4revising, consolidating and changing the laws relating
5thereto; relating to imposition of excise taxes by counties,
6including authorizing imposition of an excise tax on the
7rental of motor vehicles by counties of the first class; and
8providing for regional renaissance initiatives," further
9providing for how offices to be held.
10The General Assembly of the Commonwealth of Pennsylvania
11hereby enacts as follows:
12Section 1. Section 1302(a.1) of the act of August 9, 1955
13(P.L.323, No.130), known as The County Code, added July 7, 2011
14(P.L.268, No.55), is amended to read:
15Section 1302. How Offices to Be Held.--* * *
16(a.1) Notwithstanding subsection (a) or any other law, a
17county advancing from the fifth to fourth class as a result of
18census figures certified after the primary election in the year
19of a municipal election [shall] may maintain the configuration
20of offices in effect in the county as long as the county deems
21appropriate. At such time as a county decides that
22reconfiguration of the offices in the county in accordance with
1subsection (a) or any other general law applicable to the
2holding of offices and to the classification of the county is
3appropriate, the county shall wait until the year in which the
4offices are next up for election[, at which time offices in the
5county shall be held in accordance with subsection (a) or any
6other general law applicable to the holding of offices and to
7the classification of the county] to effect that change.
