AN ACT

 

1Amending Title 18 (Crimes and Offenses) of the Pennsylvania
2Consolidated Statutes, in assault, further providing for the
3offense of aggravated assault.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. Section 2702(a)(5) and (c)(2) and (27) of Title
718 of the Pennsylvania Consolidated Statutes, amended October
824, 2012 (P.L.1205, No.150), are amended and subsection (d) is
9amended by adding a definition to read:

10§ 2702. Aggravated assault.

11(a) Offense defined.--A person is guilty of aggravated
12assault if he:

14(5) attempts to cause or intentionally or knowingly
15causes bodily injury to a teaching staff member, school board
16member or other employee, including a student employee, of
17any elementary or secondary publicly-funded educational
18institution, any elementary or secondary private school

1licensed by the Department of Education or any elementary or
2secondary parochial school while acting in the scope of his
3or her employment or because of his or her employment
4relationship to the school, or a crossing guard while acting 
5in the scope of his or her official capacity as designated by 
6a political subdivision, school entity or police department;

8(c) Officers, employees, etc., enumerated.--The officers,
9agents, employees and other persons referred to in subsection
10(a) shall be as follows:

12(2) Firefighter, including volunteer firefighters and 
13special fire police.

15(27) A teaching staff member, a school board member or
16other employee, including a student employee, of any
17elementary or secondary publicly funded educational
18institution, any elementary or secondary private school
19licensed by the Department of Education or any elementary or
20secondary parochial school while acting in the scope of his
21or her employment or because of his or her employment
22relationship to the school, or a crossing guard while acting 
23in the scope of his or her official capacity as designated by 
24a political subdivision, school entity or police department.

26(d) Definitions.--As used in this section, the following
27words and phrases shall have the meanings given to them in this
28subsection:

30"Public utility employee or an employee of an electric 

1cooperative." The term includes all of the following:

2(1) An employee of a public utility.

3(2) An employee of a municipally owned utility.

4(3) An employee of a cable television company.

5(4) An employee of an electric distribution company.

6(5) An employee of an electric generation company.

7(6) An independent contractor or an employee of an
8independent contractor working on behalf of a cable
9television company, a public utility, a municipally owned
10utility, an electric distribution company, an electric
11generation company or an electric cooperative.

12(7) An employee of a telecommunications carrier.

13(8) An independent contractor or an employee of an
14independent contractor working on behalf of a
15telecommunications carrier.

16(9) An employee of a telephone or telecommunications
17cooperative.

18(10) An independent contractor or an employee of an
19independent contractor working on behalf of a telephone or
20telecommunications cooperative.

21Section 2. This act shall take effect as follows:

22(1) The following provisions shall take effect
23immediately:

24(i) The addition of the definition of "public 
25utility employee or an employee of an electric 
26cooperative" in 18 Pa.C.S. § 2702(d).

27(ii) This section.

28(2) The remainder of this act shall take effect in 60
29days.
