AN ACT

 

1Amending the act of December 17, 1981 (P.L.435, No.135), 
2entitled "An act providing for the regulation of pari-mutuel 
3thoroughbred horse racing and harness horse racing 
4activities; imposing certain taxes and providing for the 
5disposition of funds from pari-mutuel tickets," further 
6providing for the composition of the State Horse Racing 
7Commission <-and the State Harness Racing Commission.

8The General Assembly of the Commonwealth of Pennsylvania
9hereby enacts as follows:

<-10Section 1. Section 201(a) of the act of December 17, 1981 
11(P.L.435, No.135), known as the Race Horse Industry Reform Act, 
12is amended to read:

16Section 201. Establishment of the commissions.

17(a) The State Horse Racing Commission is hereby established 
18as a departmental administrative commission within the 
19Department of Agriculture. The commission shall have general
 

1jurisdiction over all pari-mutuel thoroughbred horse racing 
2activities in the Commonwealth and the corporations engaged 
3therein. For the purposes of this act, "thoroughbred horse 
4racing" means that form of horse racing in which each 
5participating horse is mounted by a jockey, is duly registered 
6with the Jockey Club, New York, New York and engages in races on 
7the flat. Thoroughbred horse racing may include a steeplechase 
8or hurdle race. The commission shall consist of three members, 
9not more than two of whom shall at the time of the appointment 
10reside in the same county, who shall be appointed by the 
11Governor, by and with the advice and consent of the Senate. Each 
12commissioner shall hold office for a term of three years and 
13until a successor is qualified.

<-14(b) The State Harness Racing Commission is hereby 
15established as a departmental administrative commission within 
16the Department of Agriculture. The commission shall have general 
17jurisdiction over all pari-mutuel harness racing activities in 
18the Commonwealth and the corporations engaged therein. The 
19commission shall consist of three members, not more than two of 
20whom shall at the time of the appointment reside in the same 
21county, who shall be appointed by the Governor, by and with the 
22advice and consent of the Senate. Each commissioner shall hold 
23office for a term of three years and until a successor is 
24qualified.

26Section 2. The provisions of this act shall apply to
27individuals nominated as members of the State Horse Racing
28Commission <-and the State Harness Racing Commission after the
29effective date of this section.

30Section 3. This act shall take effect in 60 days.
