AN ACT
1Amending the act of December 17, 1981 (P.L.435, No.135),
2entitled "An act providing for the regulation of pari-mutuel
3thoroughbred horse racing and harness horse racing
4activities; imposing certain taxes and providing for the
5disposition of funds from pari-mutuel tickets," further
6providing for the composition of the State Horse Racing
7Commission.
8The General Assembly of the Commonwealth of Pennsylvania
9hereby enacts as follows:
10Section 1. Section 201(a) of the act of December 17, 1981
11(P.L.435, No.135), known as the Race Horse Industry Reform Act,
12is amended to read:
13Section 201. Establishment of the commissions.
14(a) The State Horse Racing Commission is hereby established
15as a departmental administrative commission within the
16Department of Agriculture. The commission shall have general
17jurisdiction over all pari-mutuel thoroughbred horse racing
18activities in the Commonwealth and the corporations engaged
19therein. For the purposes of this act, "thoroughbred horse
20racing" means that form of horse racing in which each
1participating horse is mounted by a jockey, is duly registered
2with the Jockey Club, New York, New York and engages in races on
3the flat. Thoroughbred horse racing may include a steeplechase
4or hurdle race. The commission shall consist of three members,
5not more than two of whom shall at the time of the appointment
6reside in the same county, who shall be appointed by the
7Governor, by and with the advice and consent of the Senate. Each
8commissioner shall hold office for a term of three years and
9until a successor is qualified.

11Section 2. The provisions of this act shall apply to
12individuals nominated as members of the State Horse Racing
13Commission after the effective date of this section.
14Section 3. This act shall take effect in 60 days.
