AN ACT

 

1Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2Statutes, further providing for traffic-control signals.

3The General Assembly of the Commonwealth of Pennsylvania
4hereby enacts as follows:

5Section 1. Section 3112 of Title 75 of the Pennsylvania
6Consolidated Statutes is amended by adding a subsection to read:

7§ 3112. Traffic-control signals.

9(b.1) Pedalcycle or motorcycle.--Notwithstanding any
10provision of law to the contrary, the driver of a pedalcycle or
11motorcycle approaching an intersection that is controlled by a
12traffic-control signal utilizing a vehicle detection device that
13is inoperative due to the size of the pedalcycle or motorcycle
14shall come to a full and complete stop at the intersection and,
15after exercising due care as provided by law, may proceed with
16due caution when it is safe to do so. It is not a defense to a
17violation of subsection (a)(3) that the driver of a pedalcycle

1or motorcycle proceeded under the belief that a traffic-control
2signal utilized a vehicle detection device or was inoperative
3due to the size of the pedalcycle or motorcycle when the signal
4did not utilize a vehicle detection device or that any device
5was not in fact inoperative due to the size of the pedalcycle or
6motorcycle.

8Section 2. This act shall take effect in 60 days.
