AN ACT

 

1Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2Statutes, in licensing of drivers, requiring compliance with
3Federal Selective Service requirements.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. Title 75 of the Pennsylvania Consolidated
7Statutes is amended by adding a section to read:

8§ 1521. Compliance with Federal Selective Service requirements.

9(a) General rule.--Any United States citizen or immigrant 
10who applies for a learner's permit, identification card or 
11driver's license or a renewal of such permit, card or license 
12and who is at least 18 years of age, but less than 26 years of 
13age, must comply with the requirements of section 3 of the 
14Military Selective Service Act (62 Stat. 604, 50 U.S.C. App. § 
15451 et seq.).

16(b) Effect of applicant's signature.--The applicant's
17signature on the application shall serve as an indication that
18the applicant either has already registered with the Selective

1Service System or consents to registration if required to
2consent unless the applicant affirmatively indicates lack of
3consent by checking the box provided on the application.

4(c) Notification to applicant.--The department shall place a
5check-off box as required under subsection (b) and the following
6statement on the application:

7By signing this application you are consenting to
8registration with the Selective Service System, if so
9required by Federal law, unless you affirmatively
10indicate your lack of consent by placing a check mark in
11the box provided herein. Failure to register, if required
12to do so, is a felony.

13(d) Failure to consent.--If the applicant declines to
14consent to registration with the Selective Service System, the
15department shall not deny the applicant a license or
16identification card for failure to consent to registration.

17(e) Reporting of information.--

18(1) The department shall forward, in electronic format
19to the Selective Service System, the necessary personal
20information of the applicants required to comply with the
21Military Selective Service Act. If the applicant fails to
22consent to registration, the department shall forward, in
23electronic format to the Selective Service System, the
24necessary personal information along with a notation that
25registration was declined.

26(2) Within 60 days of forwarding the information to the
27Selective Service System under paragraph (1), the department
28shall notify the applicant in writing that the information
29has been so forwarded.

30(f) Memorandum of understanding.--The department shall seek

1to enter into a memorandum of understanding with the Selective
2Service System to obtain reimbursement of costs incurred by the
3department in carrying out the provisions of this section. The
4department shall publish in the Pennsylvania Bulletin notice of
5the execution of the memorandum of understanding within 14 days
6of its execution.

7Section 2. The addition of 75 Pa.C.S. § 1521 shall apply
8upon publication of the notice under 75 Pa.C.S. § 1521(f).

9Section 3. This act shall take effect in 60 days.
