AN ACT

 

1Amending the act of August 15, 1961 (P.L.987, No.442), entitled
2"An act relating to public works contracts; providing for
3prevailing wages; imposing duties upon the Secretary of Labor
4and Industry; providing remedies, penalties and repealing
5existing laws," allowing local governments to remove
6themselves from the jurisdiction of the act; and making
7repeals.

8The General Assembly of the Commonwealth of Pennsylvania
9hereby enacts as follows:

10Section 1. The act of August 15, 1961 (P.L.987, No.442), 
11known as the Pennsylvania Prevailing Wage Act, is amended by 
12adding a section to read:

13Section 13.1. Local Option.--Notwithstanding any provision
14of this act, a political subdivision may elect, by ordinance or
15resolution, to remove itself from the jurisdiction of this act.
16Upon adoption of an ordinance or resolution under this section,
17the political subdivision shall notify the department in
18writing. The notice shall include the date that the ordinance or
19resolution became effective.

20Section 2. Repeals are as follows:

1(1) The General Assembly declares that the repeal under
2paragraph (2) is necessary to effectuate this act.

3(2) Section 752 of the act of March 10, 1949 (P.L.30, 
4No.14), known as the Public School Code of 1949, is repealed 
5as to any political subdivision electing to opt out of the 
6jurisdiction of the act under section 13.1 of the act.

7(3) All other acts and parts of acts are repealed
8insofar as they are inconsistent with this act.

9Section 3. This act shall take effect in 60 days.
