AN ACT

 

1Amending Title 65 (Public Officers) of the Pennsylvania
2Consolidated Statutes, further defining "candidate."

3The General Assembly of the Commonwealth of Pennsylvania
4hereby enacts as follows:

5Section 1. The definition of "candidate" in section 1102 of
6Title 65 of the Pennsylvania Consolidated Statutes is amended to
7read:

8§ 1102. Definitions.

9The following words and phrases when used in this chapter
10shall have, unless the context clearly indicates otherwise, the
11meanings given to them in this section:

13"Candidate." Any individual who seeks nomination or election 
14to public office by vote of the electorate, other than a judge 
15of elections, inspector of elections or official of a political 
16party, whether or not such individual is nominated or elected. 

1An individual shall be deemed to be seeking nomination or 
2election to such office if he has:

3(1) received a contribution or made an expenditure or
4given his consent for any other person or committee to
5receive a contribution or make an expenditure for the purpose
6of influencing his nomination or election to such office,
7whether or not the individual has announced the specific
8office for which he will seek nomination or election at the
9time the contribution is received or the expenditure is made;
10or

11(2) taken the action necessary under the laws of this
12Commonwealth to qualify himself for nomination or election to
13such office.

14The term shall include individuals nominated or elected as 
15write-in candidates unless they resign such nomination or 
16elected office within 30 days of having been nominated or 
17elected. The term shall also include any individual seeking 
18nomination or election as a judicial officer except judicial 
19officers who are seeking retention under 42 Pa.C.S. § 3153 
20(relating to retention elections after regular term).

22Section 2. This act shall take effect in 60 days.
