AN ACT

 

1Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
2act relating to the public school system, including certain
3provisions applicable as well to private and parochial
4schools; amending, revising, consolidating and changing the
5laws relating thereto," further providing for election of
6school directors.

7The General Assembly of the Commonwealth of Pennsylvania
8hereby enacts as follows:

9Section 1. Section 301 of the act of March 10, 1949 (P.L.30,
10No.14), known as the Public School Code of 1949, is amended to
11read:

12Section 301. Board of Directors; Election or Appointment.--
13(a) The public school system of the Commonwealth shall be
14administered by a board of school directors, to be elected or
15appointed, as hereinafter provided. At each election of school
16directors, each qualified voter shall be entitled to cast one
17vote for each school director to be elected. Any system
18providing for cumulative voting for the office of school
19director is hereby abolished.

20(b) Except as provided in subsection (c), school directors

1shall be elected in accordance with the act of June 3, 1937
2(P.L.1333, No.320), known as the "Pennsylvania Election Code."

3(c) A primary election for school director nominations shall
4not be held for the 2015 municipal elections and thereafter.
5School directors shall be elected at the November municipal
6election beginning in 2015.

7(d) Notwithstanding section 951 of the "Pennsylvania 
8Election Code," nomination papers for the office of school 
9director shall be filed in the same manner as nominations of 
10candidates by political bodies or independent candidates, as 
11provided by the "Pennsylvania Election Code," without regard to 
12political party membership. Nomination papers for the office of 
13school director must include the signatures of a minimum number 
14of qualified electors, without regard to political party 
15affiliation as follows:

16(1) two hundred fifty for a school district of the first
17class;

18(2) two hundred for a school district of the first class A;

19(3) one hundred for a school district of the second class;

20(4) fifty for a school district of the third class; and

21(5) twenty-five for a school district of the fourth class.

22Section 2. Section 302.1(d) of the act, added December 19,
231975 (P.L.511, No.150), is amended to read:

24Section 302.1. School Board in First Class A School 
25Districts; Apportionment of Seats, and Numbers, Terms, and 
26Methods for Election of School Directors in First Class A School 
27Districts.--* * *

28[(d) Nomination and Elections of School Directors. School
29directors shall be nominated and elected in accordance with the
30act of June 3, 1937 (P.L.1333, No.320), known as the

1"Pennsylvania Election Code."]

3Section 3. All acts and parts of acts are repealed insofar
4as they are inconsistent with this act.

5Section 4. This act shall take effect as follows:

6(1) The amendment of section 301 of the act shall take
7effect December 31, 2014.

8(2) The remainder of this act shall take effect in 60
9days.
