AN ACT

 

1Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
2act relating to the public school system, including certain
3provisions applicable as well to private and parochial
4schools; amending, revising, consolidating and changing the
5laws relating thereto," in certification of teachers, further
6providing for continuing professional education for school or
7system leaders.

8The General Assembly of the Commonwealth of Pennsylvania
9hereby enacts as follows:

10Section 1. Section 1205.5 of the act of March 10, 1949
11(P.L.30, No.14), known as the Public School Code of 1949, is
12amended by adding a subsection to read:

13Section 1205.5. Continuing Professional Education for School
14or System Leaders.--* * *

15(c.1) (1) Beginning with the school year that commences
16after the effective date of this subsection, <-school or system
17leaders whose school or school district <-if every school to which
18a school or system leader is assigned makes adequate yearly
19progress or shows growth under the value-added assessment system
20as defined in section 221 for the three prior school years<-, then

1the school or system leader shall be exempt from the
2requirements of subsections (a) and (b) <-for each year thereafter
3until any of such schools fails to make adequate yearly progress
4or show growth under the value-added assessment system or until
5the school or system leader is no longer assigned to the schools
6that meet the requirements for exemption under this subsection.

7(2) If <-the school or school district a school fails to make
8adequate yearly progress or show growth under the value-added
9assessment system in any school year <-that commences after the
10effective date of this subsection, the school or system leaders
11assigned to that school or school district shall comply with
12subsections (a) and (b) until the school or school district
13again makes adequate yearly progress or shows growth under the
14value-added assessment system for three consecutive school
15years. <-in which its school or system leaders are exempt under
16paragraph (1), then the school or system leader assigned to the
17school shall resume compliance with subsections (a) and (b) by
18satisfying the unmet requirements of the compliance period that
19the school or system leader was obligated to complete
20immediately prior to the exemption. The school or system leader
21shall have the remaining duration of the uncompleted compliance
22period to satisfy the unmet requirements before a new compliance
23period begins for the school or system leader. The school making
24adequate yearly progress or showing growth under the value-added
25assessment system for another three consecutive school years
26shall stay the unmet compliance requirements and period if the
27school or system leader requalifies for exemption under
28subsection (c)(1).

29(3) If a school or system leader exempt under subsection
30(c)(1) is for any reason no longer assigned to a school with

1school or system leaders who are exempt under paragraph (c)(1),
2the school or system leader shall resume compliance with
3subsections (a) and (b) by resuming to satisfy the unmet
4requirements of the compliance period that the school or system
5leader was obligated to complete immediately prior to the
6exemption. The school or system leader shall, within the
7remaining duration of that uncompleted compliance period,
8satisfy the unmet requirements before a new compliance period
9begins for the school or system leader. The assignment of a
10school or system leader to a school that has made adequate
11yearly progress or shows growth under the value-added assessment
12system for three consecutive school years shall stay the unmet
13compliance requirements and period if the school or system
14leader requalifies for exemption under paragraph (1).

15(4) Nothing in this subsection shall be construed to exempt
16any school or system leader from any continuing professional
17education required by the school or school district to which the
18school or system leader is assigned.

19(5) For the purpose of this subsection, the following words
20and phrases shall have the meanings given to them in this
21paragraph unless the context clearly indicates otherwise:

22"Compliance period" shall have the meaning given to it under
23section 1205.2.

24"School" shall mean any specific school administered within a
25school district.
