AN ACT

 

<-1Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
2act relating to the public school system, including certain
3provisions applicable as well to private and parochial
4schools; amending, revising, consolidating and changing the
5laws relating thereto," in teacher certification, further
6providing for qualifying certificates and kinds of
7certificates.

<-8Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
9act relating to the public school system, including certain
10provisions applicable as well to private and parochial
11schools; amending, revising, consolidating and changing the
12laws relating thereto," in teacher certification, providing
13for military science certificates.

14The General Assembly of the Commonwealth of Pennsylvania
15hereby enacts as follows:

<-16Section 1. Sections 1201 and 1203 of the act of March 10,
171949 (P.L.30, No.14), known as the Public School Code of 1949,
18amended June 30, 2011 (P.L.112, No.24), are amended to read:

19Section 1201. Certificates Qualifying Persons to Teach.--
20Only those persons holding one of the following certificates
21shall be qualified to teach in the public schools of this
22Commonwealth--(1) Permanent college certificate, (2) provisional
23college certificate, (3) normal school diploma, (4) normal

1school certificate, (5) special permanent certificate, (6)
2special temporary certificate, (7) permanent State certificate,
3(8) residency certificate, (8.1) military science certificate,
4(9) intern certificate, (10) certificates which are permanent
5licenses to teach by virtue of the provisions of section one
6thousand three hundred eight of the act, approved the eighteenth
7day of May, one thousand nine hundred eleven (Pamphlet Laws
8309), as amended, which is repealed hereby, or (11) such other
9kinds of certificates as are issued under the standards
10prescribed by the State Board of Education. The State Board of
11Education shall also provide for issuance of certificates by
12district superintendents to meet such emergencies or shortage of
13teachers as may occur.

14Section 1203. Kinds of State Certificates.--(a) State
15certificates hereafter granted shall include the following:

16Provisional College Certificates,

17Permanent College Certificates,

18Certificates issued by other states and validated by the
19Superintendent of Public Instruction,

20Special Temporary Certificates,

21Special Permanent Certificates,

22Residency Certificates,

23Intern Certificates,

24Military Science Certificates.

25(b) All persons receiving any of such certificates shall
26have qualifications not less than graduation from a State
27Teachers' College of this Commonwealth, or equivalent training.
28Postbaccalaureate certification programs, including residency,
29intern and administrative certification programs completed under
30section 1207.1 are equivalent training for purposes of this act.

1(b.1) All persons receiving military science certificates
2shall have documentation of at least twenty years' military
3service and certification by the appropriate branch of the armed
4forces of the United States authorizing employment as a military
5science instructor.

6(c) Every college certificate shall set forth the names of
7the college or university from which its holder was graduated.
8State certificates shall entitle their holders to teach in every
9part of this Commonwealth for the terms herein specified.

10Section 2. This act shall take effect in 60 days.

<-11Section 1. The act of March 10, 1949 (P.L.30, No.14), known
12as the Public School Code of 1949, is amended by adding a
13section to read:

14Section 1207.2. Military Science Certificates.--(a)
15Notwithstanding any other provision of law to the contrary, the
16Secretary of Education may issue a Pennsylvania military science
17teaching certificate to a person who meets the following:

18(1) possesses a valid military science certificate or
19endorsement issued by a branch of the United States Armed Forces
20authorizing the person to teach military science and the Junior
21Reserve Officer Training Corps; and

22(2) satisfies the requirements under section 1209.

23(b) A Pennsylvania military science certificate may be
24issued to a person possessing the qualifications listed under
25subsection (a)(1) and (2) without meeting additional education
26and assessment requirements for issuance.

27(c) A Pennsylvania military science certificate issued under
28this section shall qualify a person to teach military science or
29Junior Reserve Officer Training Corps in the public schools of
30this Commonwealth.

1(d) Except as provided under this section, no area of
2certification may be added to a Pennsylvania military science
3certificate through only testing unless the person holds a valid
4Pennsylvania instructional certificate endorsed in another
5subject area.

6Section 2. This act shall take effect in 60 days.
