1Requiring background checks of persons who coach youth athletic
2teams.

3The General Assembly of the Commonwealth of Pennsylvania
4hereby enacts as follows:

5Section 1. Background checks.

6(a) Requirement.--A person who seeks to coach a youth
7athletic team that is organized and supervised by a recreational
8youth athletics organization or entity shall provide to the
9organization or entity a background check that reports whether
10the potential coach has a criminal or abusive history.

11(b) Criminal history.--A potential coach, to satisfy the
12requirement of subsection (a) regarding criminal history, shall
13provide a report of criminal history record information from the
14Pennsylvania State Police or a statement from the Pennsylvania
15State Police that the Pennsylvania State Police central
16repository contains no such information relating to that person.
17The criminal history record information shall be limited to that
18which is disseminated pursuant to 18 Pa.C.S. § 9121(b)(2)

1(relating to general regulations) and shall be no more than one
2year old.

3(c) Abusive history.--A potential coach, to satisfy the
4requirement of subsection (a) regarding abusive history, shall
5provide an official clearance statement obtained from the
6Department of Public Welfare within the immediately preceding
7year as to whether the person is named as the individual
8responsible for injury or abuse in an indicated report or a
9founded report.

10(d) File.--The recreational youth athletics organization or
11entity shall maintain a copy of the required information for so
12long as the person coaches for the organization or entity.

13Section 2. Effective date.

14This act shall take effect in 60 days.
