AN ACT

 

1Amending Title 18 (Crimes and Offenses) of the Pennsylvania
2Consolidated Statutes, further providing for the offense of
3carrying a false identification card.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. Section 6310.3 of Title 18 of the Pennsylvania
7Consolidated Statutes is amended by adding a subsection to read:

8§ 6310.3. Carrying a false identification card.

10(f) Confiscation.--

11(1) Any employee, servant or agent of a person 
12authorized to sell liquor or malt or brewed beverages under 
13the act of April 12, 1951 (P.L.90, No.21), known as the 
14Liquor Code, may confiscate an identification card that has 
15been presented for the purposes of obtaining liquor or malt 
16or brewed beverages when there is a reasonable suspicion that 
17a person has presented an identification card as described in 
18subsection (a). An employee, servant or agent may confiscate 

1an identification card upon reasonable suspicion that the age 
2or date of birth is false only after placing the 
3identification card through an electronic scanner.

4(2) The identification card confiscated under this 
5subsection shall be submitted to the law enforcement agency 
6having jurisdiction over the municipality in which the 
7licensee's place of business is located within 48 hours after 
8confiscation to make a determination of the validity of the 
9identification card presented. The law enforcement agency 
10shall return any confiscated identification card that is 
11determined to be valid to the individual from whom it was 
12confiscated.

13Section 2. This act shall take effect in 60 days.
