AN ACT

 

1Amending Title 23 (Domestic Relations) of the Pennsylvania
2Consolidated Statutes, in support matters generally, further
3providing for information to consumer reporting agency, for
4general administration of support matters; and for expedited
5procedure.

6The General Assembly of the Commonwealth of Pennsylvania
7hereby enacts as follows:

8Section 1. Section 4303 of Title 23 of the Pennsylvania
9Consolidated Statutes is amended to read:

10§ 4303. Information to consumer reporting agency.

11(a) Overdue support.--Information regarding the name and the
12amount of arrearages owed by an obligor shall be provided
13periodically to consumer reporting agencies whenever the obligor
14owes overdue support, subject to the following:

15(1) The information shall be available only after the
16obligor owing the arrearages has been notified of the
17proposed action and given a period not to exceed 20 days to
18contest the accuracy of the information. The notice shall be
19as provided by local rule of the court of common pleas.

1(2) Such information shall not be made available to:

2(i) a consumer reporting agency which the department
3determines not to have sufficient capability to
4systematically and timely make accurate use of such
5information; or

6(ii) an entity which has not furnished evidence
7satisfactory to the department that the entity is a
8consumer reporting agency.

9(b) Petition to provide record of payments.--An obligor who
10is subject to a support order under this part may petition the
11court as part of the court's support order to direct the
12domestic relations section to provide periodic information to a
13consumer reporting agency that includes the record of payment of
14support to the domestic relations section as provided in section
154325 (relating to payment of order of support).

16Section 2. Section 4305(a) of Title 23 is amended by adding
17a paragraph to read:

18§ 4305. General administration of support matters.

19(a) Powers and duties.--Subject to any inconsistent general
20rules and to the supervision and direction of the court, the
21domestic relations section shall have the power and duty to:

23(12) Subject to approval of the court upon petition of
24an obligor, provide monthly reporting to a credit reporting
25agency concerning the timely payments of support as provided
26in section 4303 (relating to information to consumer
27reporting agency).

29Section 3. Section 4342(g) of Title 23 is amended to read:

30§ 4342. Expedited procedure.

2(g) Payment record.--A copy of the record of support
3payments prepared by the domestic relations section and
4certified as a true copy of the original by the custodian of the
5record is evidence of facts asserted in it and is admissible to
6show whether payments were made in any civil proceeding, 
7including, but not limited to, any action under Title 13 
8(relating to commercial code) and for purposes of any consumer 
9credit reporting.

11Section 4. This act shall take effect in 60 days.
