AN ACT

 

1Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2Statutes, in accidents and accident reports, further
3providing for the offenses of accidents involving death or
4personal injury and for accidents involving damage to
5attended vehicle or property; and providing for the offense
6of leaving scene of accident.

7The General Assembly of the Commonwealth of Pennsylvania
8hereby enacts as follows:

9Section 1.  Sections 3742(a) and 3743(a) of Title 75 of the
10Pennsylvania Consolidated Statutes are amended to read:

11§ 3742.  Accidents involving death or personal injury.

12(a)  General rule.--[The] Except as otherwise provided in 
13section 3743.2 (relating to leaving scene of accident), the
14driver of any vehicle involved in an accident resulting in
15injury or death of any person shall immediately stop the vehicle
16at the scene of the accident or as close thereto as possible but
17shall then forthwith return to and in every event shall remain
18at the scene of the accident until he has fulfilled the
19requirements of section 3744 (relating to duty to give
20information and render aid). Every stop shall be made without

1obstructing traffic more than is necessary.

3§ 3743.  Accidents involving damage to attended vehicle or
4property.

5(a)  General rule.--[The] Except as otherwise provided in 
6section 3743.2 (relating to leaving scene of accident), the
7driver of any vehicle involved in an accident resulting only in
8damage to a vehicle or other property which is driven or
9attended by any person shall immediately stop the vehicle at the
10scene of the accident or as close thereto as possible but shall
11forthwith return to and in every event shall remain at the scene
12of the accident until he has fulfilled the requirements of
13section 3744 (relating to duty to give information and render
14aid). Every stop shall be made without obstructing traffic more
15than is necessary.

17Section 2.  Title 75 is amended by adding a section to read:

18§ 3743.2.  Leaving scene of accident.

19(a)  General rule.--The driver of a vehicle involved in an
20accident subject to the provisions of section 3742 (relating to
21accidents involving death or personal injury) or 3743 (relating
22to accidents involving damage to attended vehicle or property)
23who is in reasonable fear of his safety or the safety of his
24passengers:

25(1)  May leave the scene of the accident.

26(2)  Shall report the accident by telephone or in person
27to the nearest police department as soon as safely possible
28after the accident.

29(3)  Shall submit to the police department the
30information specified in section 3744 (relating to duty to

1give information and render aid).

2(b)  Penalty.--Any person violating this section commits a
3summary offense and shall, upon conviction, be sentenced to pay
4a fine of $300 or to imprisonment for not more than 90 days, or
5both.

6Section 3.  This act shall take effect in 60 days.
