AN ACT

 

1Amending the act of July 9, 2008 (1st Sp.Sess., P.L.1873, No.1),
2entitled "An act providing for alternative sources of energy;
3establishing the Alternative Energy Development Program, the
4Consumer Energy Program, the Home Energy Efficiency Loan
5Program, the Home Energy Efficiency Loan Fund and the
6Alternative Energy Production Tax Credit Program; and
7providing for the powers and duties of the Department of
8Environmental Protection," further providing for pollution
9control technology projects; and providing for energy service
10project grants.

11The General Assembly of the Commonwealth of Pennsylvania
12hereby enacts as follows:

13Section 1.  Section 304(a) of the act of July 9, 2008 (1st
14Sp.Sess., P.L.1873, No.1), known as the Alternative Energy
15Investment Act, is amended to read:

16Section 304.  Pollution control technology projects.

17(a)  Allocation.--The sum of [$25,000,000] $20,000,000 shall
18be transferred by the authority to the department for pollution
19control technology projects. The funds shall be utilized for
20grants to electric generating units or cogeneration units, as
21defined under 25 Pa. Code § 123.202 (relating to definitions),

1that utilize coal, as defined under 25 Pa. Code § 123.202, as
2their primary fuel source, and that have an installed capacity
3of less than 500 megawatts, located in this Commonwealth.

5Section 2.  The act is amended by adding a section to read:

6Section 308.  Energy service project grants.

7The sum of $5,000,000 shall be used by the department for
8grants to political subdivisions for energy service project
9initiatives. The department shall develop guidelines governing
10implementation of this program.

11Section 3.  The Department of Environmental Protection shall
12use the sum of $5,000,000 from funds originally appropriated to
13it under section 304(a) of the act to fund energy service
14project grants authorized under section 308 of the act.

15Section 4.  This act shall take effect immediately.
