AN ACT

 

1Amending Title 62 (Procurement) of the Pennsylvania Consolidated
2Statutes, in small and disadvantaged businesses, further
3providing for definitions and for regulations.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. The definition of "small business" in section
72102 of Title 62 of the Pennsylvania Consolidated Statutes is
8amended to read:

9§ 2102. Definitions.

10Subject to section 2103 (relating to regulations), the
11following words and phrases when used in this chapter shall have
12the meanings given to them in this section unless the context
13clearly indicates otherwise:

15"Small business." A business in the United States which is
16independently owned, is not dominant in its field of operation
17and employs [100] 150 or fewer employees.

18Section 2. Section 2103 of Title 62 is amended to read:

1§ 2103. Regulations.

2(a) General rule.--The department shall establish policy for
3executive and those independent agencies for which the
4department acts as purchasing agency and may promulgate
5regulations establishing detailed definitions of the words and
6phrases defined in section 2102 (relating to definitions) using,
7in addition to the criteria set forth in section 2102, other
8criteria as it deems appropriate, including the number of
9employees and the dollar volume of business. State-affiliated
10entities shall implement the policy for their procurement
11programs.

12(b) Revision.--Within 60 days of the effective date of this
13subsection, the department shall revise the policy established
14under subsection (a). The revision shall include adjustment of
15the dollar volume of business requirements or gross annual
16revenue limitations to account for the increase in the number of
17employees required to qualify as a small business under section
182102. The revision shall be published in the Pennsylvania
19Bulletin.

20Section 3. This act shall take effect in 60 days.
