1Amending Titles 34 (Game) and 75 (Vehicles) of the Pennsylvania
2Consolidated Statutes, providing for the removal of deer
3carcasses.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. Section 322(c) of Title 34 of the Pennsylvania
7Consolidated Statutes is amended by adding a paragraph to read:

8§ 322. Powers and duties of commission.

9* * *

10(c) Specific powers and duties.--In order to administrate
11and enforce this title, the commission through proper action
12shall:

14(14) Within 48 hours of notification of the location of
15a deer carcass on a roadway, remove the carcass from the
16roadway. For the purposes of this paragraph, a roadway shall
17mean a roadway as defined in 75 Pa.C.S. § 102 (relating to

1definitions), except that the term shall not include a
2roadway under the jurisdiction of the Department of
3Transportation.

4Section 2. Title 75 is amended by adding a section to read:

5§ 6109.1. Specific duties of department.

6The department shall have the following duties:

7(1) To, within 48 hours of notification of the location
8of a deer carcass on a roadway, remove the carcass from the
9roadway and properly dispose of the carcass under the
10guidance of the Pennsylvania Game Commission. For the
11purposes of this paragraph, a roadway shall not include a
12roadway under the jurisdiction of a local authority.

14Section 3. This act shall take effect in 60 days.
