AN ACT

 

1Amending Title 42 (Judiciary and Judicial Procedure) of the 
2Pennsylvania Consolidated Statutes, in sentencing, further
3providing for collection of restitution, reparation, fees,
4costs, fines and penalties.

5The General Assembly of the Commonwealth of Pennsylvania
6hereby enacts as follows:

7Section 1. Section 9728(a)(2) of Title 42 of the
8Pennsylvania Consolidated Statutes is amended to read:

9§ 9728. Collection of restitution, reparation, fees, costs,
10fines and penalties.

11(a) General rule.--

13(2) In accordance with section 9730.1 (relating to
14collection of court costs, restitution and fines by private
15collection agency), the collection of restitution,
16reparation, fees, costs, fines and penalties under this
17section may be referred to a private collection agency. Any 
18county that does not engage the services of a private 
19collection agency shall establish a collections enforcement
 

1unit, consistent with the provisions of paragraph (1) and 
2dedicated to carrying out the duties therein provided.
3Statistical information relating to the amount of restitution
4collected by the county probation department or any agent
5designated by the county commissioners of the county with the
6approval of the president judge of the county shall be made
7available to the Pennsylvania Commission on Crime and
8Delinquency on an annual basis. The statistical information 
9shall be sufficiently detailed so as to show compliance with 
10the requirements of this section, including subsection (g.1).

12Section 2. This act shall take effect in 60 days.
