AN ACT

 

1Amending Title 65 (Public Officers) of the Pennsylvania
2Consolidated Statutes, in ethics standards and financial
3disclosure, further providing for statement of financial
4interests required to be filed.

5The General Assembly of the Commonwealth of Pennsylvania
6hereby enacts as follows:

7Section 1. Section 1104(b) and (e) of Title 65 of the
8Pennsylvania Consolidated Statutes are amended to read:

9§ 1104. Statement of financial interests required to be filed.

11(b) Candidate.--

12(1) Any candidate for a State-level public office shall
13file a statement of financial interests for the preceding
14calendar year with the commission on or before the last day
15for filing a petition to appear on the ballot for election. A
16copy of the statement of financial interests shall also be
17appended to such petition.

18(2) Any candidate for county-level or local office shall

1file a statement of financial interests for the preceding
2calendar year with the governing authority of the political
3subdivision in which he is a candidate on or before the last
4day for filing a petition to appear on the ballot for
5election. A copy of the statement of financial interests
6shall also be appended to such petition.

7(2.1)  Any candidate for public office shall file a copy
8of a complete and accurate record of a felony conviction, if
9any, with the commission and the governing authority of the
10political subdivision in which he is a candidate on or before
11the last day for filing to appear on the ballot for election.
12A copy of the record of a felony conviction shall also be
13appended to the nomination petition, nomination paper or
14nomination certificate.

15(3) No [petition] nomination petition, nomination paper 
16or nomination certificate to appear on the ballot for
17election shall be accepted by the respective State or local
18election officials unless the [petition] nomination petition, 
19nomination paper or nomination certificate has appended
20thereto a statement of financial interests as set forth in
21paragraphs (1) and (2). Failure to file the statement in
22accordance with the provisions of this chapter shall, in
23addition to any other penalties provided, be a fatal defect
24to a petition to appear on the ballot.

26(e) Public inspection and copying.--All statements of
27financial interests and records of a felony conviction, if any,
28filed pursuant to the provisions of this chapter shall be made
29available for public inspection and copying during regular
30office hours, and copying facilities shall be made available at

1a charge not to exceed actual cost.

2Section 2. This act shall take effect in 60 days.
