A SUPPLEMENT
1To the act of December 8, 1982 (P.L.848, No.235), entitled "An
2act providing for the adoption of capital projects related to
3the repair, rehabilitation or replacement of highway bridges
4to be financed from current revenue or by the incurring of
5debt and capital projects related to highway and safety
6improvement projects to be financed from current revenue of
7the Motor License Fund," itemizing additional State and local
8bridge projects.
9The General Assembly of the Commonwealth of Pennsylvania
10hereby enacts as follows:
11Section 1. Short title.
12This act shall be known and may be cited as the Highway-
13Railroad and Highway Bridge Capital Budget Supplemental Act for
142014-2015.
15Section 2. Definitions.
16The following words and phrases when used in this act shall
17have the meanings given to them in this section unless the
18context clearly indicates otherwise:
19"Account." The Highway Bridge Improvement Restricted Account
1within the Motor License Fund.
2"Capital project." A capital project as defined in section
3302 of the act of February 9, 1999 (P.L.1, No.1), known as the
4Capital Facilities Debt Enabling Act, and shall include a county
5or municipal bridge rehabilitation, replacement or improvement
6project as set forth in this act.
7"Department." The Department of Transportation of the
8Commonwealth.
9"Secretary." The Secretary of Transportation of the
10Commonwealth.
11Section 3. Total authorization for bridge projects.
12(a) Total projects.--The total authorization for the costs
13of the projects itemized pursuant to this act and to be financed
14from current revenue or by the incurring of debt shall be
15$000,000,000.
16(b) State projects.--The authorization for capital projects
17in the category of highway bridge projects and forestry and
18State park bridge projects to be constructed by the Department
19of Transportation or the Department of Conservation and Natural
20Resources, or their successors or assigns, and to be financed by
21the incurring of debt or from current revenue, itemized in this
22act under the category of State bridges, shall be $000,000,000.
23(c) Non-State projects.--The authorization for non-State
24highway bridge projects to be constructed by municipalities and
25to be financed in part with grants not exceeding 80% of the non-
26Federal share of the costs made to the local government
27municipalities by the department from current revenues itemized
28in this act under the category of local bridges, shall be
29$000,000,000.
30Section 4. Itemization of bridge projects.
1The individual capital projects in the category of highway
2projects to be constructed by the Department of Transportation,
3its successors or assigns, and to be financed from current
4revenue or by the incurring of debt are hereby itemized,
5together with their estimated financial costs, in the following
6sections.

27Section 72. Miscellaneous.
28(1) (Reserved).
29Section 73. Limitation on expenditure of funds.
30The following shall apply:
1(1) Any moneys derived from the incurring of debt shall
2be used solely for effecting the rehabilitation, replacement
3or removal of bridges located on State highways. All other
4bridge rehabilitation, replacement or removal shall be
5financed from current revenue.
6(2) Notwithstanding any law to the contrary, the
7projects itemized in the act of December 8, 1982 (P.L.848,
8No.235), known as the Highway-Railroad and Highway Bridge
9Capital Budget Act for 1982-1983, may be financed from
10current revenue.
11Section 74 Debt authorization.
12The Governor, Auditor General and State Treasurer are hereby
13authorized and directed to borrow from time to time, in addition
14to any authorization heretofore or hereafter enacted, on the
15credit of the Commonwealth, subject to the limitations provided
16in the current capital budget, money not exceeding in the
17aggregate the sum of $000,000,000 as may be found necessary to
18carry out the acquisition and construction of the State projects
19specifically itemized in this act.
20Section 75. Issue of bonds.
21The indebtedness authorized in this act shall be incurred
22from time to time and shall be evidenced by one or more series
23of general obligation bonds of the Commonwealth in such
24aggregate principal amount for each series as the Governor,
25Auditor General and State Treasurer shall determine, but the
26latest stated maturity date shall not exceed 30 years from the
27date of the bond first issued for each series.
28Section 76. Estimated useful life of projects.
29The General Assembly states the estimated useful life of the
30projects itemized in this act as 30 years.
1Section 77. Appropriation.
2The net proceeds of the sale of the obligations authorized in
3this act are hereby appropriated from the Capital Facilities
4Fund to the department in the maximum amount of $000,000,000 to
5be used by it exclusively to defray the financial costs of the
6State projects specifically itemized in this capital budget.
7After reserving or paying the expenses of the sale of the
8obligation, the State Treasurer shall pay out to the department
9the moneys as required and certified by it to be legally due and
10payable.
11Section 78. Federal funds.
12In addition to those funds appropriated in section 77, all
13moneys received from the Federal Government for the public
14improvement projects specifically itemized in this act are also
15hereby appropriated for those projects.
16Section 79. Allocation of funds.
17(a) General rule.--Whenever the department or the Department
18of Conservation and Natural Resources determines that the full
19estimated financial costs of the projects itemized in this act
20are not necessary for the proper design, acquisition or
21construction of such projects, the excess funds no longer
22required may be allocated by the department or the Department of
23Conservation and Natural Resources to increase the estimated
24costs of any one or more of the projects specifically itemized
25in a capital budget.
26(b) Reimbursement of municipal expenditures.--Moneys raised
27or expended by municipalities after the effective date of this
28act, in anticipation of receipt of funds authorized for projects
29itemized by this act, may be reimbursable to those
30municipalities.
1Section 80. Policy on jobs and materials.
2(a) Jobs.--It is the declared policy of the Commonwealth
3that the construction projects authorized in this act be used,
4to the greatest extent possible, to provide for the creation of
5jobs and the rehiring of the unemployed in this Commonwealth. In
6order to reach this goal, firms with Commonwealth-based
7facilities shall be actively solicited to make bids on contracts
8to furnish products and materials, including, but not limited
9to, steel and steel products, to be used in these projects.
10(b) Materials.--Every contract document entered into to
11undertake a project contained in this act shall provide that any
12steel or other products to be used or supplied in the
13performance of this contract shall be required to be
14manufactured by plants in the United States unless the secretary
15determines, on a contract by contract basis, that certain
16required products are not produced in the United States in
17sufficient quantities to meet the requirements of the contract.
18Such a determination and the reasons therefor shall be published
19in the Pennsylvania Bulletin. Decisions made under this
20subsection shall not be inconsistent with the general provisions
21of the act of March 3, 1978 (P.L.6, No.3), known as the Steel
22Products Procurement Act.
23(c) Minorities and women.--It is also the declared policy of
24the Commonwealth to require and encourage substantial
25participation by minorities and women in the construction
26projects authorized by this act.
27Section 81. Payment of capital debt service.
28The repayment of any debt incurred pursuant to this act shall
29be made from the account and such repayment shall have first
30claim on the revenues of the account.
1Section 82. Authorization and debt cumulation.
2The additional authorization and debt allowance provided for
3in this act shall be added to the total authorizations and debt
4incurred pursuant to the act of December 8, 1982 (P.L.848,
5No.235), known as the Highway-Railroad and Highway Bridge
6Capital Budget Act for 1982-1983, as amended and supplemented.
7Section 83. Editorial changes.
8In editing and preparing this act for printing following the
9final enactment, the Legislative Reference Bureau shall insert
10or revise letters or numbers for projects where the letters or
11numbers are missing or require revision. The bureau shall also
12revise the total monetary amounts for the total authorization,
13debt authorization, appropriations and departmental totals as
14necessary to agree with the total monetary amounts of the
15projects.
16Section 84. Effective date.
17This act shall take effect immediately.
