AN ACT

 

1Amending the act of July 23, 1970 (P.L.563, No.195), entitled
2"An act establishing rights in public employes to organize
3and bargain collectively through selected representatives;
4defining public employes to include employes of nonprofit
5organizations and institutions; providing compulsory
6mediation and fact-finding, for collective bargaining
7impasses; providing arbitration for certain public employes
8for collective bargaining impasses; defining the scope of
9collective bargaining; establishing unfair employe and
10employer practices; prohibiting strikes for certain public
11employes; permitting strikes under limited conditions;
12providing penalties for violations; and establishing
13procedures for implementation," further providing for the
14definition of "membership dues deduction"; and providing for
15the definition of "political contributions" and for
16reimbursement of a public employer for administrative costs.

17The General Assembly of the Commonwealth of Pennsylvania
18hereby enacts as follows:

19Section 1. Sections 301(11) of the act of July 23, 1970
20(P.L.563, No.195), known as the Public Employe Relations Act, is
21amended and the section is amended by adding a paragraph to
22read:

23Section 301. As used in this act:

1(11) "Membership dues deduction" means the practice of a
2public employer to deduct from the wages of a public employe,
3with his written consent, an amount for the payment of his
4membership dues in an employe organization, which deduction is
5transmitted by the public employer to the employe organization.
6The employe organization shall reimburse the public employer for 
7the reasonable administrative costs incurred in the deduction 
8and transmission of the membership dues.

10(20) "Political contribution" means funds appropriated for
11lobbying, electoral activity or independent expenditure on
12behalf of or contribution to a candidate, political party, voter
13registration campaign or other political or legislative cause.
14If a public employer, pursuant to a collective bargaining
15agreement, agrees to collect political contributions from an
16employe, the employe organization shall reimburse the public
17employer for the reasonable administrative costs incurred in the
18collection and transmission of the political contributions.

19Section 2. Section 705 of the act is amended to read:

20Section 705. Membership dues deductions and maintenance of
21membership are proper subjects of bargaining with the proviso
22that as to the latter, the payment of dues and assessments while
23members, may be the only requisite employment condition. When 
24applicable, the employe organization shall reimburse the public 
25employer for the reasonable administrative costs incurred in the 
26deduction and transmission of membership dues and collection and 
27transmission of political contributions.

28Section 3. This act shall take effect in 60 days.
