AN ACT

 

1Amending Title 18 (Crimes and Offenses) of the Pennsylvania
2Consolidated Statutes, further providing for exceptions to
3prohibition of interception and disclosure of communications.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. Section 5704 of Title 18 of the Pennsylvania
7Consolidated Statutes is amended by adding a paragraph to read:

8§ 5704. Exceptions to prohibition of interception and
9disclosure of communications.

10It shall not be unlawful and no prior court approval shall be
11required under this chapter for:

13(19) Any victim of or witness to bullying as defined in
14section 1303.1-A of the act of March 10, 1949 (P.L.30,
15No.14), known as the Public School Code of 1949, to intercept
16the contents of any electronic or oral communication while on
17school property or at a school-sponsored event, if that
18person is under a reasonable suspicion that the intercepted

1party is committing, about to commit or has committed
2bullying and there is reason to believe that evidence of
3bullying may be obtained from the interception. The victim or
4witness shall not publish, reproduce or transmit the contents
5of the electronic or oral communication.

6Section 2. This act shall take effect in 60 days.
