AN ACT

 

1Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2Statutes, in accidents and accident reports, further
3providing for accidents involving death or personal injury
4while not properly licensed.

5The General Assembly of the Commonwealth of Pennsylvania
6hereby enacts as follows:

7Section 1. Section 3742.1 of Title 75 of the Pennsylvania
8Consolidated Statutes is amended to read:

9§ 3742.1. Accidents involving death or personal injury while
10not properly licensed.

11(a) Offense defined.--A person whose operating privilege was
12disqualified, canceled, recalled, revoked or suspended and not
13restored or who does not hold a valid driver's license and
14applicable endorsements for the type and class of vehicle being
15operated commits an offense under this section if the person was
16the driver of any vehicle and:

17(1) caused an accident resulting in injury or death of

1any person; or

2(2) was involved in an accident resulting in injury or 
3death of any person.

4(b) Penalties.--

5(1) Except as otherwise provided in this section, any
6person violating subsection (a) commits a misdemeanor of the
7second degree.

8(2) If the victim suffers serious bodily injury or
9death, any person violating subsection (a)(1) commits a
10felony of the third degree.

11(2.1) If the person who violates subsection (a)
12unintentionally causes the serious bodily injury of another
13person as a result of the accident, the person shall, upon
14conviction, be sentenced to pay a fine of not more than
15$2,500.

16(2.2) If the person who violates subsection (a)
17unintentionally causes the death of another person as a
18result of the accident, the person shall, upon conviction, be
19sentenced to pay a fine of not more than $5,000.

20(3) Any motor vehicle, as defined in section 102
21(relating to definitions), used in the commission of an
22offense under this section may be deemed contraband and
23forfeited in accordance with the provisions set forth in 18 
24Pa.C.S. § 6501(d) (relating to scattering rubbish).

25Section 2. This act shall take effect in 60 days.
