AN ACT

 

1Amending Titles 30 (Fish) and 34 (Game) of the Pennsylvania
2Consolidated Statutes, in enforcement, further providing for
3powers and duties of waterways conservation officers and 
4deputies and for powers and duties of enforcement officers.

5The General Assembly of the Commonwealth of Pennsylvania
6hereby enacts as follows:

7Section 1. Section 901 of Title 30 of the Pennsylvania
8Consolidated Statutes is amended by adding a subsection to read:

9§ 901. Powers and duties of waterways conservation officers and
10deputies.

12(c) Exception to the prohibition of interception and
13disclosure of communications.--A waterways conservation officer
14whose duty it is to enforce this title <-and who has received 
15training under 18 Pa.C.S. § 5724 (relating to training) shall be
16defined as a law enforcement officer for the purpose of 18
17Pa.C.S. § 5704(16)(iii) (relating to exceptions to prohibition
18of interception and disclosure of communications). <-Such
 

1waterways conservation officers may wear body cameras in the 
2performance of their official duties. This subsection shall not
3apply to a deputy waterways conservation officer.

4Section 2. Section 901 of Title 34 is amended by adding a
5subsection to read:

6§ 901. Powers and duties of enforcement officers.

8(b.1) Exception to the prohibition of interception and
9disclosure of communications.--An officer whose duty it is to
10enforce this title <-and who has received training under 18 
11Pa.C.S. § 5724 (relating to training) shall be defined as a law
12enforcement officer for the purpose of 18 Pa.C.S. § 5704(16)
13(iii) (relating to exceptions to prohibition of interception and
14disclosure of communications). <-Such officers may wear body 
15cameras in the performance of their official duties. This
16subsection shall not apply to a deputy Game Commission officer
17or deputy wildlife conservation officer.

19Section 3. This act shall take effect in 60 days.
