1Amending Title 42 (Judiciary and Judicial Procedure) of the
2Pennsylvania Consolidated Statutes, in judicial computer
3system, further providing for utilization of funds in account
4and for surcharge; and repealing annual appropriations
5provisions.

6The General Assembly of the Commonwealth of Pennsylvania
7hereby enacts as follows:

8Section 1. Section 3732(a) of Title 42 of the Pennsylvania
9Consolidated Statutes is amended and the section is amended by
10adding a subsection to read:

11§ 3732. Utilization of funds in account.

12(a) General rule.--Except [for the repayments under
13subsection (b)] as set forth under subsections (b) and (c), all
14moneys deposited into the Judicial Computer System Augmentation
15Account shall be used only for the initial startup and the
16ongoing operations of the Statewide judicial computer system.

18(c) Cadet classes.--Notwithstanding any other provision of
19law to the contrary, all moneys deposited into the Judicial

1Computer System Augmentation Account shall be transferred to the
2Pennsylvania State Police for cadet classes.

3Section 2. Section 3733.1(c) of Title 42 is amended to read:

4§ 3733.1. Surcharge.

6(c) Allocation and appropriation.--

7(1) The surcharge under subsection (a)(1) shall be
8allocated as follows:

9(i) One dollar shall be deposited into the Access to
10Justice Account.

11(ii) The remainder of money shall be deposited into
12[a separate reserve account within] the Judicial Computer
13System Augmentation Account. [Notwithstanding section
143732 (relating to utilization of funds in account), money
15deposited under this subparagraph is hereby appropriated
16to the Supreme Court, upon compliance with Article XV of
17the act of April 9, 1929 (P.L.343, No.176), known as The
18Fiscal Code, for the operation of the Judicial
19Department.]

20(2) The fee under subsection (a)(2) shall be deposited
21into the Criminal Justice Enhancement Account.

22Section 3. Section 3734 of Title 42 is repealed:

23[§ 3734. Annual appropriations.

24Beginning with the fiscal year 1987-1988, the General
25Assembly shall appropriate initially from the General Fund and
26thereafter from the Judicial Computer System Augmentation
27Account funds sufficient to meet the costs of the initial
28startup and the ongoing operations of the Statewide judicial
29computer system.]

30Section 4. The amendment, addition or repeal of 42 Pa.C.S.

1§§ 3732(a) and (c), 3733.1(c) and 3734 shall apply to moneys
2deposited into the Judicial Computer System Augmentation Account
3on or after July 1, 2014.

4Section 5. This act shall take effect immediately.
