AN ACT

 

1Amending the act of November 6, 1987 (P.L.381, No.79), entitled
2"An act relating to the protection of the abused, neglected,
3exploited or abandoned elderly; establishing a uniform
4Statewide reporting and investigative system for suspected
5abuse, neglect, exploitation or abandonment of the elderly;
6providing protective services; providing for funding; and
7making repeals," in administration, providing for Statewide
8registry of perpetrators of abuse in facilities.

9The General Assembly of the Commonwealth of Pennsylvania
10hereby enacts as follows:

11Section 1. The act of November 6, 1987 (P.L.381, No.79),
12known as the Older Adults Protective Services Act, is amended by
13adding a section to read:

14Section 312. Statewide registry of perpetrators of abuse in
15facilities.

16(a) Establishment.--The department shall establish a
17Statewide registry of persons found to be substantiated
18perpetrators of abuse, neglect, abandonment or exploitation of 
19older persons in facilities.

1(b) Information in registry.--The registry shall include,
2but not be limited to, the following:

3(1) The name, Social Security number, age, sex and
4address of the perpetrator.

5(2) The facility or facilities where the perpetrator
6committed the abuse, neglect, abandonment or exploitation.

7(3) A description of the abuse, neglect, abandonment or
8exploitation committed by the perpetrator, including the date
9or dates of the incidents.

10(c) Expungement.--The department shall immediately expunge
11information in the registry pertaining to any perpetrator where
12the finding of the agency, as defined in 6 Pa. Code § 15.2
13(relating to definitions), has been reversed upon appeal under 6
14Pa. Code § 15.82(3) (relating to rights of alleged abusers).

15(d) Information submitted by prospective employees.--
16Administrators of facilities shall require prospective employees
17to submit with their applications for employment a certification
18from the department as to whether the applicant is named in the
19registry as a perpetrator. The certificate must be obtained
20within the one-year period of the submission date of the
21application.

22(e) Regulations.--The department shall promulgate the
23regulations necessary to carry out this section.

24(f) Confidentiality.--The department shall comply with
25sections 306 and 705 with regard to the confidentiality of
26information contained within the registry.

27Section 2. This act shall take effect in 180 days.
