AN ACT

 

1Amending Title 23 (Domestic Relations) of the Pennsylvania
2Consolidated Statutes, in child protective services, further
3providing for definitions and for information relating to
4family day-care home residents.

5The General Assembly of the Commonwealth of Pennsylvania
6hereby enacts as follows:

7Section 1. Section 6303(a) of Title 23 of the Pennsylvania
8Consolidated Statutes is amended by adding a definition to read:

9§ 6303. Definitions.

10(a) General rule.--The following words and phrases when used
11in this chapter shall have the meanings given to them in this
12section unless the context clearly indicates otherwise:

14"Relative/neighbor care." Child care provided by an
15individual who cares for three or fewer children unrelated to
16the individual in the individual's home.

18Section 2. Section 6344.1(a) and (c) of Title 23 are amended
19to read:

1§ 6344.1. Information relating to family day-care home and 
2relative/neighbor care residents.

3(a) General rule.--In addition to the requirements of
4section 6344 (relating to information relating to prospective
5child-care personnel), an individual who applies to the
6department for a registration certificate to operate a family
7day-care home or to provide relative/neighbor care shall include
8criminal history record and child abuse record information
9required under section 6344(b) for every individual 18 years of
10age or older who resides in the home for at least 30 days in a
11calendar year.

13(c) Effect on registration.--The department shall refuse to
14issue or renew a registration certificate or shall revoke a
15registration certificate if the family day-care home provider or 
16relative/neighbor care provider or individual 18 years of age or
17older who has resided in the home for at least 30 days in a
18calendar year:

19(1) is named in the central register on child abuse
20established under Chapter 63 (relating to child protective
21services) as the perpetrator of a founded report committed
22within the immediately preceding five-year period; or

23(2) has been convicted of an offense enumerated in
24section 6344(c).

26Section 3. This act shall take effect in 60 days.
