AN ACT

 

1Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2Statutes, in registration of vehicles, further providing for
3person with disability plate and placard; and, in rules of
4the road in general, further providing for additional parking
5regulations.

6The General Assembly of the Commonwealth of Pennsylvania
7hereby enacts as follows:

8Section 1. Section 1338(d) of Title 75 of the Pennsylvania
9Consolidated Statutes is amended to read:

10§ 1338. Person with disability plate and placard.

12(d) Penalty.--Any person violating this section commits a
13summary offense and shall, upon conviction, be sentenced to pay
14a fine [of not more than $100.] as follows:

15(1) Two hundred fifty dollars for a first offense.

16(2) Five hundred dollars for a second offense.

17(3) Seven hundred fifty dollars for a third or
18subsequent offense.

2Section 2. Section 3354(d)(3)(i) and (f) of Title 75 are
3amended and the section is amended by adding a subsection to
4read:

5§ 3354. Additional parking regulations.

7(d) Person with a disability and disabled veterans.--

9(3) (i) Except for persons parking vehicles lawfully
10bearing a person with a disability or severely disabled
11veteran registration plate or displaying a person with a
12disability or severely disabled veteran parking placard when
13such vehicles are being operated by or for the transportation
14of a person with a disability or a severely disabled veteran,
15no person shall park a vehicle on public or private property
16reserved for a person with a disability or severely disabled
17veteran which property has been so posted in accordance with
18departmental regulations. Regulations shall require that
19parking spaces designated with an international symbol for
20access for persons with disabilities on a sign are posted
21with a sign stating the penalty amount indicated in
22subsection (f) and that vehicles in violation of the
23subsection may be towed and require that signs be replaced
24when they become either obsolete or missing with all costs to
25replace the necessary signs to be borne by the persons
26responsible for signing the particular location. The sign
27shall state, in effect, if you see a vehicle parking in this 
28space that does not bear a person with a disability or 
29severely disabled veteran registration plate or displaying a 
30person with a disability or severely disabled veteran parking
 

1placard, call the toll-free telephone number established or 
2designated under subsection (d.1). The absence of a sign
3stating the penalty amount at parking spaces designated with
4an international symbol for access for persons with
5disabilities shall not preclude the enforcement of this
6subsection. A vehicle which is unlawfully parked in a
7designated person with a disability parking area may be
8removed from that area by towing and may be reclaimed by the
9vehicle owner upon payment of the towing costs. A vehicle may
10only be towed under this paragraph if the parking space is
11posted with a sign indicating that vehicles in violation of
12this section may be towed.

14(d.1) Hotline.--The department shall establish or designate
15a toll-free telephone number to report violations under
16subsection (e).

18(f) Penalty.--A person violating subsection (a), (b) or (d)
19(1) is guilty of a summary offense and shall, upon conviction,
20be sentenced to pay a fine of not more than $15. A person
21violating subsection (d)(2) or (3) or (e) is guilty of a summary
22offense and shall, upon conviction, be sentenced to pay a fine
23[of not less than $50 nor more than $200.] as follows:

24(1) Two hundred fifty dollars for a first offense.

25(2) Five hundred dollars for a second offense.

26(3) Seven hundred fifty dollars for a third or 
27subsequent offense.

28If a person is convicted under subsection (d)(2) or (3) in the
29absence of a sign stating the penalty amount, the fine imposed
30may not exceed $50.

2Section 3. This act shall take effect in 60 days.
