AN ACT

 

1Providing for certain labels relating to funding by taxpayers to
2be included on certain public materials and publicly
3accessible Internet websites of the Commonwealth.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. Short title.

7This act shall be known and may be cited as the Taxpayer
8Funding Label Act.

9Section 2. Definitions.

10The following words and phrases when used in this act shall
11have the meanings given to them in this section unless the
12context clearly indicates otherwise:

13"Commonwealth agency." Any of the following:

14(1) The Governor and any department, board or
15commission, authority or agency of the Commonwealth
16government.

17(2) A court or other officer or agency of the unified
18judicial system.

1(3) The General Assembly and any of its officers or
2agencies.

3"Commonwealth official." An elected or appointed member or
4employee of the executive, legislative or judicial branch of the
5Commonwealth government.

6"Commonwealth website." A publicly accessible Internet
7website of a Commonwealth agency or Commonwealth official.

8"Public material." A document, paper, letter, map, book,
9tape, photograph, film or sound recording, information stored or
10maintained electronically and a data-processed or image-
11processed document, or other information, regardless of physical
12form or characteristics, that documents a transaction or
13activity of a Commonwealth agency or Commonwealth official, is
14created, received or retained pursuant to law or in connection
15with a transaction, business or activity of a Commonwealth
16agency or Commonwealth official, is made available to members of
17the general public and is paid for by Commonwealth funds.

18Section 3. Taxpayer funding labels required.

19All public materials and Commonwealth websites shall include
20a label that states: "Prepared or Complied Using Taxpayer
21Resources."

22Section 4. Applicability.

23This act shall apply to public materials produced after the
24effective date of this section and to Commonwealth websites
25regardless of their creation date.

26Section 5. Construction.

27Nothing in this act shall be construed to prohibit
28Commonwealth agencies or Commonwealth officials from using
29existing stock of public materials produced prior to the
30effective date of this section.

1Section 6. Effective date.

2This act shall take effect in 60 days.
