AN ACT

 

1Amending the act of June 3, 1937 (P.L.1333, No.320), entitled
2"An act concerning elections, including general, municipal,
3special and primary elections, the nomination of candidates,
4primary and election expenses and election contests; creating
5and defining membership of county boards of elections;
6imposing duties upon the Secretary of the Commonwealth,
7courts, county boards of elections, county commissioners;
8imposing penalties for violation of the act, and codifying,
9revising and consolidating the laws relating thereto; and
10repealing certain acts and parts of acts relating to
11elections," in district election officers, further providing
12for qualifications of election officers and for vacancies in
13election boards.

14The General Assembly of the Commonwealth of Pennsylvania
15hereby enacts as follows:

16Section 1. Section 402(a) of the act of June 3, 1937
17(P.L.1333, No.320), known as the Pennsylvania Election Code,
18amended December 9, 2002 (P.L.1246, No.150), is amended to read:

19Section 402. Qualifications of Election Officers.--(a)
20Except as provided in subsection (b) and section 405(a.2) and 
21(c), election officers shall be qualified registered electors of
22the district in which they are elected or appointed. No person
23shall be qualified to serve as an election officer who shall

1hold, or shall within two months have held, any office,
2appointment or employment in or under the Government of the
3United States or of this State or of any city or county or poor
4district, of any municipal board, commission or trust in any
5city, save only district justices, notaries public and persons
6in the militia service of the State; nor shall any election
7officer be eligible to any civil office to be voted for at a
8primary or election at which he shall serve, except that of an
9election officer.

11Section 2. Section 405 of the act is amended by adding a
12subsection to read:

13Section 405. Vacancies in Election Boards; Appointment;
14Judge and Majority Inspector to Be Members of Majority Party;
15Minority Inspector to Be Member of Minority Party.--* * *

16(a.2) Vacancies in minority inspectors may be filled by a
17qualified registered elector of the county in which the election
18district is located.

20Section 3. This act shall take effect in 60 days.
