AN ACT

 

1Amending Title 18 (Crimes and Offenses) of the Pennsylvania
2Consolidated Statutes, in firearms and other dangerous
3articles, further providing for licenses.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. Section 6109(b) and (i.1)(1) of Title 18 of the
7Pennsylvania Consolidated Statutes are amended to read:

8§ 6109. Licenses.

10(b) Place of application.--

11(1) An individual who is 21 years of age or older may
12apply to a sheriff for a license to carry a firearm concealed
13on or about his person or in a vehicle within this
14Commonwealth.

15(2) [If] Except as otherwise provided in paragraph (3), 
16if the applicant is a resident of this Commonwealth, he shall
17make application with the sheriff of the county in which he
18resides or[, if] the sheriff of a county contiguous to the
 

1county in which he resides.

2(3) If the applicant is a resident of a city of the
3first class, he shall make application with the chief of
4police of that city, the sheriff of the county in which he 
5resides or the sheriff of a county contiguous to the county 
6in which he resides.

8(i.1) Notice to sheriff.--Notwithstanding any statute to the
9contrary:

10(1) Upon conviction of a person for a crime specified in
11section 6105(a) or (b) or upon conviction of a person for a
12crime punishable by imprisonment exceeding one year or upon a
13determination that the conduct of a person meets the criteria
14specified in section 6105(c)(1), (2), (3), (5), (6) or (9),
15the court shall determine if the defendant has a license to
16carry firearms issued pursuant to this section. If the
17defendant has such a license, the court shall notify the
18sheriff of the county [in which that person resides] that 
19issued the license, on a form developed by the Pennsylvania
20State Police, of the identity of the person and the nature of
21the crime or conduct which resulted in the notification. The
22notification shall be transmitted by the judge within seven
23days of the conviction or determination.

25Section 2. This act shall take effect in 60 days.
