A JOINT RESOLUTION

 

1Proposing an amendment to the Constitution of the Commonwealth
2of Pennsylvania, providing for recall of elected public
3officers.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby resolves as follows:

6Section 1. The following amendment to the Constitution of
7Pennsylvania is proposed in accordance with Article XI:

8That Article VI be amended by adding a section to read:

9§ 8. Recall of elected public officers.

10All elected public officers, except judicial officers, are
11subject to recall by the voters of the Commonwealth or political
12subdivision from which elected for malfeasance or nonfeasance.
13The procedures for recall shall be prescribed by the General
14Assembly.

15Section 2. (a) Upon the first passage by the General
16Assembly of this proposed constitutional amendment, the
17Secretary of the Commonwealth shall proceed immediately to
18comply with the advertising requirements of section 1 of Article

1XI of the Constitution of Pennsylvania and shall transmit the
2required advertisements to two newspapers in every county in
3which such newspapers are published in sufficient time after
4passage of this proposed constitutional amendment.

5(b) Upon the second passage by the General Assembly of this
6proposed constitutional amendment, the Secretary of the
7Commonwealth shall proceed immediately to comply with the
8advertising requirements of section 1 of Article XI of the
9Constitution of Pennsylvania and shall transmit the required
10advertisements to two newspapers in every county in which such
11newspapers are published in sufficient time after passage of
12this proposed constitutional amendment. The Secretary of the
13Commonwealth shall submit this proposed constitutional amendment
14to the qualified electors of this Commonwealth at the first
15primary, general or municipal election which meets the
16requirements of and is in conformance with section 1 of Article
17XI of the Constitution of Pennsylvania and which occurs at least
18three months after the proposed constitutional amendment is
19passed by the General Assembly.
