AN ACT

 

1Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2Statutes, further providing for application for driver's
3license or learner's permit, for issuance and content of
4driver's license and for expiration and renewal of drivers'
5licenses.

6The General Assembly of the Commonwealth of Pennsylvania
7hereby enacts as follows:

8Section 1. Sections 1506(a) and (a.1), 1510(f) and (i) and
91514(e) of Title 75 of the Pennsylvania Consolidated Statutes
10are amended to read:

11§ 1506. Application for driver's license or learner's permit.

12(a) Form and content.--Every application for a learner's
13permit or driver's license shall be made upon a form furnished
14by the department and shall contain such information as the
15department may require to determine the applicant's identity,
16competency and eligibility. The form shall allow for submission 
17of a Social Security number or a taxpayer identification number. 
18The form may also provide for inclusion of personal medical
19information and other information of use in an emergency.

1[(a.1) Noncitizen application.--A person who is not a
2citizen of the United States may apply for a Pennsylvania
3driver's license upon establishing the person's lawful presence
4in the United States and this Commonwealth. The department may
5issue a license if the person will lawfully be in the United
6States for a period of one year or more after the date of the
7application or for a shorter period of time if deemed
8appropriate by the department.]

10§ 1510. Issuance and content of driver's license.

12(f) Waiver.--Notwithstanding the provisions of subsection
13(a), the department shall issue a driver's license to an
14otherwise eligible person who has no Social Security number if
15the person submits a [waiver obtained from the Federal
16Government permitting him not to have a Social Security number.
17The department may require other identifiers, including, but not
18limited to, a taxpayer identification number, before issuing the
19license.] Federal taxpayer identification number or a Federal 
20waiver for nonissuance of a Social Security number for reasons 
21of religion. If an applicant does not have a taxpayer 
22identification number, documents or a combination of documents 
23that reliably proves the applicant's name, date of birth and 
24place of birth shall be submitted. The department shall accept 
25the following documents and shall only require a combination of 
26them if necessary to establish name, date of birth and place of 
27birth of an applicant:

28(1) A valid foreign passport from the person's country
29of citizenship.

30(2) A valid consular identification document issued by
 

1governments with safety standards and protocols as determined 
2by the department.

3(3) A certified record of the applicant's birth,
4marriage, adoption or divorce, including a translation if
5necessary.

7[(i) Issuance to noncitizens.--A license issued in
8accordance with section 1506(a.1) (relating to application for
9driver's license or learner's permit) may contain an indication
10that the license was issued to the person who is not a citizen
11of the United States and who has credentials or documents issued
12by the Immigration and Naturalization Service or its successor.]

14§ 1514. Expiration and renewal of drivers' licenses.

16[(e) Noncitizen license expiration and renewal.--

17(1) Except as otherwise provided, a license issued on
18the basis of Immigration and Naturalization Service (INS)
19credentials or documents shall expire on the date appearing
20on the INS credentials or documents provided by the applicant
21under section 1506(a.1) (relating to application for driver's
22license or learner's permit).

23(2) If the expiration date of the INS credentials or
24documents exceeds four years, the license shall expire one
25day after the applicant's date of birth but not more than
26four years from the date of issuance of the license.

27(3) Upon presenting INS credentials or documents
28indicating continued legal presence in the United States, the
29person may apply for a renewal of the license.

30(4) If a person has been granted permanent legal status

1in the United States by the INS, the department may in its
2discretion require the person to present his INS credentials
3or documents for only the first license application or
4renewal.

5(5) License renewals issued under this subsection shall
6be for the length of time as set forth in paragraph (1) or
7(2).]

8Section 2. This act shall take effect in 60 days.
