AN ACT

 

1Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2Statutes, in inspection of vehicles, further providing for 
3requirement for periodic inspection of vehicles.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. Section 4702(g) of Title 75 of the Pennsylvania
7Consolidated Statutes, is amended by adding paragraphs and the
8section is amended by adding subsections to read:

9§ 4702. Requirement for periodic inspection of vehicles.

11(g) Exceptions.--The following are exceptions to subsection
12(f):

14(5) Emission inspection criteria for newest model year
15vehicles.--A subject vehicle never before registered in this
16Commonwealth or any other jurisdiction shall be exempt from
17the requirements for emission inspection for five years from

1the model year in which the vehicle was manufactured.

2(6) Emission inspection criteria for alternative fuel
3vehicles.--A subject vehicle powered exclusively by electric,
4hybrid electric or compressed natural gas shall be exempt
5from the requirements for emission inspection. A certificate
6of exemption shall be affixed to the subject vehicle in a
7manner prescribed by department regulations.

8(h) Notification to Environmental Protection Agency.--The
9department, in consultation with the Department of Environmental
10Protection, shall immediately notify the Environmental
11Protection Agency of the modifications to the vehicle emission
12program in subsection (g)(5) and (6) and of the intent to seek
13its approval of the plan in accordance with the requirements of
14Federal law.

15(i) Anti-tampering inspections.--Notwithstanding the
16provisions of subsection (g)(5) and (6), newest five model year
17and alternative fuel vehicles shall be subject to visual anti-
18tampering inspections for the presence of emissions control
19components installed on the vehicle by manufacturers.

20Section 2. This act shall take effect in 60 days.
