AN ACT

 

1Amending Titles 42 (Judiciary and Judicial Procedure) and 53
2(Municipalities Generally) of the Pennsylvania Consolidated
3Statutes, in selection and retention of judicial officers,
4further providing for content of course of instruction and
5examination; and, in municipal police education and training,
6further providing for powers and duties of Municipal Police
7Officers' Education and Training Commission.

8The General Assembly of the Commonwealth of Pennsylvania
9hereby enacts as follows:

10Section 1. Section 3113(b) of Title 42 of the Pennsylvania
11Consolidated Statutes is amended to read:

12§ 3113. Content of course of instruction and examination.

14(b) Content of course.--The course of training and
15instruction shall not exceed four weeks in duration and shall
16consist of a minimum of 40 hours of class instruction in civil
17and criminal law, including evidence and procedure, summary
18proceedings, motor vehicles, the identification of mental health 
19conditions and intellectual disabilities and the availability of
 

1diversionary options for individuals suffering from mental 
2health conditions or intellectual disabilities and courses in
3judicial ethics, in the case of all such officials except
4arraignment court magistrates, in which case the course of
5training shall consist of a minimum of 30 hours of class
6instruction in criminal law, search and seizure, arrest and bail
7practices and procedures, and except judges of the Traffic Court
8of Philadelphia, in which case the course of training shall
9consist of a minimum of 20 hours of class instruction in summary
10proceedings and laws relating to motor vehicles.

11Section 2. Section 2164 of Title 53 is amended by adding a
12paragraph to read:

13§ 2164. Powers and duties of commission.

14The powers and duties of the commission shall be as follows:

16(1.1) To provide annual training for police officers
17with respect to:

18(i) Recognition of mental health conditions and 
19intellectual disabilities.

20(ii) Proper techniques to interact and de-escalate
21individuals suffering from mental health episodes or
22episodes stemming from intellectual disabilities.

23(iii) Instruction on alternative services or
24diversionary options available to individuals suffering
25from mental health conditions or intellectual 
26disabilities.

28Section 3. This act shall take effect in 60 days.
