AN ACT

 

1Amending Title 18 (Crimes and Offenses) of the Pennsylvania
2Consolidated Statutes, further providing for Pennsylvania
3State Police and for licensing of dealers.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. Section 6111.1(b)(1) of Title 18 of the
7Pennsylvania Consolidated Statutes is amended to read:

8§ 6111.1. Pennsylvania State Police.

10(b) Duty of Pennsylvania State Police.--

11(1) Upon receipt of a request for a criminal history,
12juvenile delinquency history and mental health record check
13of the potential purchaser [or], transferee[,] or dealer or 
14employee of a dealer, the Pennsylvania State Police shall
15immediately during the licensee's call or by return call
16forthwith:

17(i) review the Pennsylvania State Police criminal

1history and fingerprint records to determine if the
2potential purchaser or transferee is prohibited from
3receipt or possession of a firearm under Federal or State
4law;

5(ii) review the juvenile delinquency and mental
6health records of the Pennsylvania State Police to
7determine whether the potential purchaser or transferee
8is prohibited from receipt or possession of a firearm
9under Federal or State law; and

10(iii) inform the licensee making the inquiry either:

11(A) that the potential purchase or transfer is
12prohibited; or

13(B) provide the licensee with a unique approval
14number.

16Section 2. Section 6113(a) of Title 18 is amended by adding
17a paragraph to read:

18§ 6113. Licensing of dealers.

19(a) General rule.--The chief or head of any police force or
20police department of a city, and, elsewhere, the sheriff of the
21county, shall grant to reputable applicants licenses, in form
22prescribed by the Pennsylvania State Police, effective for three
23years from date of issue, permitting the licensee to sell
24firearms direct to the consumer, subject to the following
25conditions in addition to those specified in section 6111
26(relating to sale or transfer of firearms), for breach of any of
27which the license shall be forfeited and the licensee subject to
28punishment as provided in this subchapter:

30(8) The dealer and an employee of a dealer who will

1engage in the sale of firearms undergo a background check as
2provided under this chapter.

4Section 3. This act shall take effect in 60 days.
