AN ACT
1To provide from the General Fund for the expenses of the
2Executive and Judicial Departments, the State Government
3Support Agencies and the General Assembly of the
4Commonwealth, the public debt and the public schools for the
5fiscal year July 1, 2013, to June 30, 2014, for certain
6institutions and organizations, and for the payment of bills
7incurred and remaining unpaid at the close of the fiscal year
8ending June 30, 2013; to provide appropriations from the
9State Lottery Fund, the Tobacco Settlement Fund, the Aviation
10Restricted Account, the Hazardous Material Response Fund, The
11State Stores Fund, the Milk Marketing Fund, the Home
12Investment Trust Fund, the Emergency Medical Services
13Operating Fund, the Tuition Account Guaranteed Savings
14Program Fund, the Banking Fund, the Firearm Records Check
15Fund, the Ben Franklin Technology Development Authority Fund,
16the Oil and Gas Lease Fund, the Home Improvement Account, the
17Cigarette Fire Safety and Firefighter Protection Act
18Enforcement Fund and the Energy Conservation and Assistance
19Fund, to the Executive Department; to provide appropriations
20from the Judicial Computer System Augmentation Account to the
21Judicial Department for the fiscal year July 1, 2013, to June
2230, 2014; to provide appropriations from the Motor License
23Fund for the fiscal year July 1, 2013, to June 30, 2014, for
24the proper operation of several departments of the
25Commonwealth and the Pennsylvania State Police authorized to
26spend Motor License Fund moneys; to provide for the
27appropriation of Federal funds to the Executive Department of
28the Commonwealth and for the payment of bills remaining
29unpaid at the close of the fiscal year ending June 30, 2013;
30and to provide for the additional appropriation of Federal

8The General Assembly of the Commonwealth of Pennsylvania
9hereby enacts as follows:
10PART I
11GENERAL PROVISIONS
12Section 101. Short title.
13This act shall be known and may be cited as the General
14Appropriation Act of 2013.
15Section 102. Definitions.
16The following words and phrases when used in this act shall
17have the meanings given to them in this section unless the
18context clearly indicates otherwise:
19"Employees." Includes all directors, superintendents, bureau
20or division chiefs, assistant directors, assistant
21superintendents, assistant chiefs, experts, scientists,
22engineers, surveyors, draftsmen, accountants, secretaries,
23auditors, inspectors, examiners, analysts, statisticians,
24marshals, clerks, stenographers, bookkeepers, messengers and
25other assistants in any department, board or commission.
26"Expenses" and "maintenance." Includes all printing, binding
27and stationery, food and forage, materials and supplies,
28traveling expenses, training, motor vehicle supplies and
29repairs, freight, express and cartage, postage, telephones and
30telegraph rentals and toll charges, newspaper advertising and
1notices, public advertising by or through any medium, fuel,
2light, heat, power and water, minor construction and renovation,
3repairs or reconstruction of equipment, buildings and
4facilities, rent of real estate and equipment, premiums on
5workers' compensation, insurance premiums on policies of
6liability insurance, insurance premiums on medical payment
7insurance and surety bonds for volunteer workers, premiums on
8employee group life insurance and employee and retired employee
9group hospital and medical insurance, payment of Commonwealth
10share of Social Security taxes and unemployment compensation
11costs for State employees, the purchase of replacement or
12additional equipment and machinery and all other incidental
13costs and expenses, including payment to the Department of
14General Services of mileage and other charges for the use of
15automobiles and rental payments for permanently assigned
16automobiles and of expenses or costs of services incurred
17through the Purchasing Fund. The term "expenses" also shall
18include the medical costs for the treatment of inmates of State
19institutions when the inmate must be transferred to an outside
20hospital, provided, that in no case shall the State institution
21pay more for patient care than that provided under the State
22medical assistance program.
23Section 103. Abbreviations.
24The following abbreviations when used in this act shall have
25the meanings given to them in this section unless the context
26clearly indicates otherwise:

3Section 104. State appropriations.
4(a) General Fund.--The following sums set forth in this act,
5or as much thereof as may be necessary, are hereby specifically
6appropriated from the General Fund to the several hereinafter
7named agencies of the Executive, Legislative and Judicial
8Departments of the Commonwealth for the payment of salaries,
9wages or other compensation and travel expenses of the duly
10elected or appointed officers and employees of the Commonwealth,
11for the payment of fees for contractual services rendered, for
12the purchase or rental of goods and services, printing, public
13advertising by or through any medium, equipment, land and
14buildings and for payment of any other expenses, as provided by
15law or by this act, necessary for the proper conduct of the
16duties, functions and activities and for the purposes
17hereinafter set forth for the fiscal year beginning July 1,
182013, and for the payment of bills incurred and remaining unpaid
19at the close of the fiscal year ending June 30, 2013.
20(b) State Lottery Fund.--The following sums set forth in
21this act, or as much thereof as may be necessary, are hereby
22specifically appropriated from the State Lottery Fund to the
23several hereinafter named agencies of the Executive Department
24of the Commonwealth for the payment of salaries, wages or other
25compensation and travel expenses of the duly appointed officers
26and employees of the Commonwealth, for the payment of fees for
27contractual services rendered, for the purchase or rental of
28goods and services and for payment of any other expenses, as
29provided by law or by this act, necessary for the proper conduct
30of the duties, functions and activities and for the purposes
1hereinafter set forth for the fiscal year beginning July 1,
22013, and for the payment of bills incurred and remaining unpaid
3at the close of the fiscal year ending June 30, 2013.
4(c) Tobacco Settlement Fund.--The following sums set forth
5in this act, or as much thereof as may be necessary, are hereby
6specifically appropriated from the Tobacco Settlement Fund to
7the hereinafter named agencies of the Executive Department of
8the Commonwealth for the payment of salaries, wages or other
9compensation and travel expenses of the duly appointed officers
10and employees of the Commonwealth, for the payment of fees for
11contractual services rendered, for the purchase or rental of
12goods and services and for payment of any other expenses, as
13provided by law or by this act, necessary for the proper conduct
14of the duties, functions and activities and for the purposes
15hereinafter set forth for the fiscal year beginning July 1,
162013, and for the payment of bills incurred and remaining unpaid
17at the close of the fiscal year ending June 30, 2013.
18(d) Judicial Computer System Augmentation Account.--The
19following sums set forth in this act, or as much thereof as may
20be necessary, are hereby specifically appropriated from the
21restricted receipt account established within the General Fund,
22known as the Judicial Computer System Augmentation Account, to
23the Judicial Department of the Commonwealth for the payment of
24salaries, wages or other compensation and travel expenses, for
25the payment of fees for contractual services rendered, for the
26purchase or rental of goods and services and for the payment of
27any other expenses, as provided by law or by this act, necessary
28for the proper conduct of the duties, functions and activities
29and for the purposes hereinafter set forth for the fiscal year
30beginning July 1, 2013, and for the payment of bills incurred
1and remaining unpaid at the close of the fiscal year ending June
230, 2013.
3(e) Emergency Medical Services Operating Fund.--The
4following sums set forth in this act, or as much thereof as may
5be necessary, are hereby specifically appropriated from the
6Emergency Medical Services Operating Fund to the several
7hereinafter named agencies of the Executive Department of the
8Commonwealth for the payment of fees for contractual services
9rendered, for the purchase or rental of goods and services and
10for the payment of any other expenses, as provided by law or by
11this act, necessary for the proper conduct of the duties,
12functions and activities and for the purposes hereinafter set
13forth for the fiscal year beginning July 1, 2013, and for the
14payment of bills incurred and remaining unpaid at the close of
15the fiscal year ending June 30, 2013.
16(f) The State Stores Fund.--The following sums set forth in
17this act, or as much thereof as may be necessary, are hereby
18specifically appropriated from The State Stores Fund to the
19hereinafter named agency of the Executive Department of the
20Commonwealth for the payment of salaries, wages or other
21compensation and travel expenses of the duly appointed officers
22and employees of the Commonwealth, for the payment of fees for
23contractual services rendered, for the purchase or rental of
24goods and services and for the payment of any other expenses, as
25provided by law or by this act, necessary for the proper conduct
26of the duties, functions and activities and for the purposes
27hereinafter set forth for the fiscal year beginning July 1,
282013, and for the payment of bills incurred and remaining unpaid
29at the close of the fiscal year ending June 30, 2013.
30(g) Motor License Fund.--The following sums, or as much
1thereof as may be necessary, are hereby appropriated from the
2Motor License Fund to the hereinafter named agencies of the
3Executive Department for the payment of salaries, wages and
4other compensation and travel expenses of the duly elected or
5appointed officers and employees of the Commonwealth, for
6contractual services and other expenses necessary for the proper
7conduct of the duties, functions and activities for the purposes
8hereinafter set forth for the fiscal year beginning July 1,
92013, and for the payment of bills incurred and remaining unpaid
10at the close of the fiscal year ending June 30, 2013.
11(h) Aviation Restricted Account.--The following sums, or as
12much thereof as may be necessary, are hereby appropriated from
13the Aviation Restricted Account in the Motor License Fund to the
14hereinafter named agencies of the Executive Department for the
15purposes set forth herein for the fiscal year beginning July 1,
162013, and for the payment of bills incurred and remaining unpaid
17at the close of the fiscal year ending June 30, 2013.
18(i) Hazardous Material Response Fund.--The following sums
19set forth in this act, or as much thereof as may be necessary,
20are hereby specifically appropriated from the Hazardous Material
21Response Fund to the several hereinafter named agencies of the
22Executive Department of the Commonwealth for the payment of fees
23for contractual services rendered, for the purchase or rental of
24goods and services and for the payment of any other expenses, as
25provided by law or by this act, necessary for the proper conduct
26of the duties, functions and activities and for the purposes
27hereinafter set forth for the fiscal year beginning July 1,
282013, and for the payment of bills incurred and remaining unpaid
29at the close of the fiscal year ending June 30, 2013.
30(j) Milk Marketing Fund.--The following sums set forth in
1this act, or as much thereof as may be necessary, are hereby
2specifically appropriated from the Milk Marketing Fund to the
3several hereinafter named agencies of the Executive Department
4of the Commonwealth for the payment of salaries, wages or other
5compensation and travel expenses of the duly appointed officers
6and employees of the Commonwealth, for the payment of fees for
7contractual services rendered, for the purchase or rental of
8goods and services and for the payment of any other expenses, as
9provided by law or by this act, necessary for the proper conduct
10of the duties, functions and activities and for the purposes
11hereinafter set forth for the fiscal year beginning July 1,
122013, and for the payment of bills incurred and remaining unpaid
13at the close of the fiscal year ending June 30, 2013.
14(k) Home Investment Trust Fund.--The following sums set
15forth in this act, or as much thereof as may be necessary, are
16hereby specifically appropriated from the Home Investment Trust
17Fund to the hereinafter named agencies of the Executive
18Department of the Commonwealth for the payment of salaries,
19wages or other compensation and travel expenses of the duly
20appointed officers and employees of the Commonwealth, for the
21payment of fees for contractual services rendered, for the
22purchase or rental of goods and services and for the payment of
23any other expenses, as provided by law or by this act, necessary
24for the proper conduct of the duties, functions and activities
25and for the purposes hereinafter set forth for the fiscal year
26beginning July 1, 2013, and for the payment of bills incurred
27and remaining unpaid at the close of the fiscal year ending June
2830, 2013.
29(l) Tuition Account Guaranteed Savings Program Fund.--The
30following sums set forth in this act, or as much thereof as may
1be necessary, are hereby specifically appropriated from the
2Tuition Account Guaranteed Savings Program Fund to the
3hereinafter named agencies of the Executive Department of the
4Commonwealth for the payment of salaries, wages or other
5compensation and travel expenses of the duly appointed officers
6and employees of the Commonwealth, for the payment of fees for
7contractual services rendered, for the purchase or rental of
8goods and services and for the payment of any other expenses, as
9provided by law or by this act, necessary for the proper conduct
10of the duties, functions and activities and for the purposes
11hereinafter set forth for the fiscal year beginning July 1,
122013, and for the payment of bills incurred and remaining unpaid
13at the close of the fiscal year ending June 30, 2013.
14(m) Banking Fund.--The following sums set forth in this act,
15or as much thereof as may be necessary, are hereby specifically
16appropriated from the Banking Fund to the hereinafter named
17agencies of the Executive Department of the Commonwealth for the
18payment of salaries, wages or other compensation and travel
19expenses of the duly appointed officers and employees of the
20Commonwealth, for the payment of fees for contractual services
21rendered, for the purchase or rental of goods and services and
22for the payment of any other expenses, as provided by law or by
23this act, necessary for the proper conduct of the duties,
24functions and activities and for the purposes hereinafter set
25forth for the fiscal year beginning July 1, 2013, and for the
26payment of bills incurred and remaining unpaid at the close of
27the fiscal year ending June 30, 2013.
28(n) Firearm Records Check Fund.--The following sums set
29forth in this act, or as much thereof as may be necessary, are
30hereby specifically appropriated from the Firearm Records Check
1Fund to the hereinafter named agencies of the Executive
2Department of the Commonwealth for the payment of salaries,
3wages or other compensation and travel expenses of the duly
4appointed officers and employees of the Commonwealth, for the
5payment of fees for contractual services rendered, for the
6purchase or rental of goods and services and for the payment of
7any other expenses, as provided by law or by this act, necessary
8for the proper conduct of the duties, functions and activities
9and for the purposes hereinafter set forth for the fiscal year
10beginning July 1, 2013, and for the payment of bills incurred
11and remaining unpaid at the close of the fiscal year ending June
1230, 2013.
13(o) Ben Franklin Technology Development Authority Fund.--The
14following sums set forth in this act, or as much thereof as may
15be necessary, are hereby specifically appropriated from the Ben
16Franklin Technology Development Authority Fund to the
17hereinafter named agencies of the Executive Department of the
18Commonwealth for the payment of salaries, wages or other

28(p) Oil and Gas Lease Fund.--The following sums set forth in

30specifically appropriated from the Oil and Gas Lease Fund to the
1hereinafter named agencies of the Executive Department of the
2Commonwealth for the payment of salaries, wages or other
3compensation and travel expenses of the duly appointed officers
4and employees of the Commonwealth, for the payment of fees for
5contractual services rendered, for the purchase or rental of
6goods and services and for payment of any other expenses, as
7provided by law or by this act, necessary for the proper conduct
8of the duties, functions and activities and for the purposes
9hereinafter set forth for the fiscal year beginning July 1,
102013, and for the payment of bills incurred and remaining unpaid
11at the close of the fiscal year ending June 30, 2013.
12(q) Home Improvement Account.--The following sums set forth
13in this act, or as much thereof as may be necessary, are hereby
14specifically appropriated from the Home Improvement Account
15within the General Fund to the hereinafter named agencies of the
16Executive Department of the Commonwealth for the payment of
17salaries, wages or other compensation and travel expenses of the
18duly appointed officers and employees of the Commonwealth, for
19the payment of fees for contractual services rendered, for the
20purchase or rental of goods and services and for payment of any
21other expenses, as provided by law or by this act, necessary for
22the proper conduct of the duties, functions and activities and
23for the purposes hereinafter set forth for the fiscal year
24beginning July 1, 2013, and for the payment of bills incurred
25and remaining unpaid at the close of the fiscal year ending June
2630, 2013.
27(r) Cigarette Fire Safety and Firefighter Protection Act
28Enforcement Fund.--The following sums set forth in this act, or
29as much thereof as may be necessary, are hereby specifically
30appropriated from the Cigarette Fire Safety and Firefighter
1Protection Act Enforcement Fund to the hereinafter named
2agencies of the Executive Department of the Commonwealth for the
3payment of salaries, wages or other compensation and travel
4expenses of the duly appointed officers and employees of the
5Commonwealth, for the payment of fees for contractual services
6rendered, for the purchase or rental of goods and services and
7for payment of any other expenses, as provided by law or by this
8act, necessary for the proper conduct of the duties, functions
9and activities and for the purposes hereinafter set forth for
10the fiscal year beginning July 1, 2013, and for the payment of
11bills incurred and remaining unpaid at the close of the fiscal
12year ending June 30, 2013.
13(s) Energy Conservation and Assistance Fund.--The following
14sums set forth in this act, or as much thereof as may be
15necessary, are hereby specifically appropriated from the Energy
16Conservation and Assistance Fund to the several hereinafter
17named agencies of the Executive Department of the Commonwealth
18for the payment of fees for contractual services rendered, for
19the purchase or rental of goods and services and for the payment
20of any other expenses, as provided by law or by this act,
21necessary for the proper conduct of the duties, functions and
22activities and for the purposes hereinafter set forth for the
23fiscal year beginning July 1, 2013, and for the payment of bills
24incurred and remaining unpaid at the close of the fiscal year
25ending June 30, 2013.
26Section 105. Federal augmentation appropriations.
27The following Federal augmentation appropriations set forth
28in this act, or as much thereof as may be necessary, are hereby
29specifically appropriated from the Federal augmentation funds to
30the several hereinafter named agencies of the Executive
1Department of the Commonwealth for the payment of the expenses
2of implementing and carrying out the programs stated herein for
3the fiscal year beginning July 1, 2013, and for the payment of
4bills incurred and remaining unpaid at the close of the fiscal
5year ending June 30, 2013. Unless otherwise stated, the
6appropriations include any carryovers from the prior fiscal
7year.
8Section 106. Block grants.
9(a) Appropriation.--The following sums set forth in this
10act, or as much thereof as may be necessary, are hereby
11specifically appropriated from the block grant (BG) funds to the
12several hereinafter named agencies of the Executive Department
13of the Commonwealth for the purposes and under the restrictions
14for which the funds are provided for the fiscal year beginning
15July 1, 2013.
16(b) Small Communities Development Block Grant.--The Small
17Communities Development Block Grant (SCDBG) is to assist small
18cities and communities that have a high concentration of
19impoverished citizens and substandard housing to expand their
20low-income and moderate-income housing opportunities and to meet
21community development needs.
22(c) Community Services Block Grant.--The Community Services
23Block Grant (CSBG) is to provide a range of services and
24activities having a measurable and potentially major impact on
25the causes of poverty in the community or those areas of the
26community where poverty is a particularly acute problem. In
27addition, new focus may be placed on the unemployed, both old
28and new. Local agencies may lower their eligibility requirements
29for recipients to three months to allow greater flexibility to
30assure proper consideration of each recipient.
1(d) Preventive Health and Health Services Block Grant.--The
2Preventive Health and Health Services Block Grant (PHHSBG) is
3for the provision of preventive health and other health services
4related to emergency medical systems, health initiative grants,
5comprehensive public health, hypertension, fluoridation, health
6education, risk reduction, home health, rape crisis and domestic
7violence services.
8(e) Maternal and Child Health Services Block Grant.--The
9Maternal and Child Health Services Block Grant (MCHSBG) is to
10enable states to maintain and strengthen their leadership in
11planning, promoting, coordinating and evaluating health care for
12pregnant women, mothers, infants and children, and children with
13special health care needs and in providing health services for
14mothers and children who do not have access to adequate health
15care.
16(f) Low-Income Home Energy Assistance Block Grant.--The Low-
17Income Home Energy Assistance Block Grant (LIHEABG) is to help
18lessen the impact of the high cost of energy on low-income
19families and individuals, including energy efficiency grants for
20low-income dwellings. No less than 15% of the LIHEABG funds
21received shall be used for weatherization. LIHEABG funds
22received pursuant to a Presidential release of contingency funds
23shall be exempt from the 15% requirement.
24(g) Social Services Block Grant.--The Social Services Block
25Grant (SSBG) is for the provision of social services to eligible
26persons.
27(h) Mental Health Services Block Grant.--The Mental Health
28Services Block Grant (MHSBG) provides funds for the provision of
29services to adults with serious mental illness or children with
30serious emotional disturbance.
1(i) Substance Abuse Block Grant.--The Substance Abuse Block
2Grant (SABG) provides funds to establish and maintain programs
3to combat alcohol and drug abuse.
4(j) Child Care and Development Fund Block Grant.--The Child
5Care and Development Fund Block Grant (CCDFBG) is for the
6provision of direct child care or to increase the quality and
7availability of child care for low-income families.
8(k) Temporary Assistance for Needy Families Block Grant.--
9The Temporary Assistance for Needy Families Block Grant (TANFBG)
10provides funds for the provision of cash grants, child care,
11training and support services, child welfare and administration
12for eligible families and individuals.

13(a) General Fund.--The following sums set forth in this
14part, or as much thereof as may be necessary, are hereby
15specifically appropriated from the General Fund to the several
16hereinafter named agencies of the Executive, Legislative and
17Judicial Departments of the Commonwealth for the payment of
18salaries, wages or other compensation and travel expenses of the
19duly elected or appointed officers and employees of the
20Commonwealth, for the payment of fees for contractual services
21rendered, for the purchase or rental of goods and services,
22printing, public advertising by or through any medium,
23equipment, land and buildings and for payment of any other

1MISCELLANEOUS PROVISIONS FOR 2012-2013
2Section 1961. Prior laws unaffected.
3This part is not intended to be inconsistent with or to
4repeal any provision of any act enacted at this or any prior
5session of the General Assembly regulating the purchase of
6supplies, the ordering of printing and binding, the purchase,
7maintenance and use of automobiles, the method of making
8payments from the State Treasury for any purpose or the
9functioning of any administrative department, board or
10commission.
11Section 1962. Compliance with other law before funds available.
12No appropriation made by this part to any department, board,
13commission or agency of the Executive Department shall be
14available unless and until the department, board, commission or
15agency has complied with sections 615 and 616 of the act of
16April 9, 1929 (P.L.177, No.175), known as The Administrative
17Code of 1929.
18Section 1963. Contracts prerequisite to encumbering or
19committing funds.
20Funds for the purchase of supplies, materials and equipment
21shall not be deemed to be committed or encumbered until
22contracts covering the purchase have been entered into with the
23vendors.
24Section 1964. Minority business set-asides.
25(a) Duty to report.--Each department or other
26instrumentality of the Commonwealth listed in Subpart B or D
27authorized to contract for buildings, highways, commodities,
28equipment, supplies or services shall report to the General
29Assembly all information pertinent to anticipated procurement
30needs at the beginning of each fiscal year and each fiscal
1quarter thereafter.
2(b) Definition.--As used in this section, the term "minority
3business" means a minority business enterprise as defined in the
4act of July 22, 1974 (P.L.598, No.206), known as the
5Pennsylvania Minority Business Development Authority Act.
6Section 1965. Appropriation of funds from miscellaneous
7sources.
8In addition to the amounts appropriated by this part:
9(1) Moneys received in payment for food and household
10supplies furnished to employees and other persons, except
11inmates, by an institution, and moneys received from the
12proceeds from the sale of any products of the soil, meats,
13livestock, timber or other materials sold by the department
14shall be paid into the General Fund and are hereby
15appropriated out of the General Fund to the several
16respective institutions for the operation and maintenance of
17the institutions.
18(2) Moneys received from any other source, except the
19Federal Government, as contributions for the programs
20provided herein or as payment for services or materials
21furnished by one institution to another, except those
22collections designated as revenues, shall be paid into the
23General Fund and are hereby appropriated out of the General
24Fund for the purposes of the respective appropriations.
25(3) Moneys received by a department or agency of the
26Commonwealth from any other source, except the Federal
27Government, as contributions or supplements to the department
28or agency for a program or administration of an act included
29in this part shall be paid into the General Fund and credited
30to the appropriation for that program or administration of
1that act.
2Section 1966. Lapsing of unused funds.
3(a) General rule.--Except as otherwise provided by law or by
4this section, that part of all appropriations in Part XIX
5unexpended, uncommitted or unencumbered as of June 30, 2013,
6shall automatically lapse as of that date.
7(b) Exception.--The appropriation in Part XIX to the
8Pennsylvania Emergency Management Agency for the Summer 2011
9Storm Disaster Relief shall be a continuing appropriation.
10Section 1967. Construction with prior appropriation acts.
11Any appropriation in Subpart B of this part which is the same
12or similar to any appropriation in the act of June 30, 2012
13(P.L.1740, No.9A), known as the General Appropriation Act of
142012, shall replace that appropriation.
15Section 1968. Deduction of expended appropriations under prior
16law.
17Any money which has been appropriated and expended under the
18act of June 30, 2012 (P.L.1740, No.9A), known as the General
19Appropriation Act of 2012, shall be deducted from the
20corresponding appropriation in this part.
21PART XX
22SPECIAL PROVISIONS FOR FEDERAL FUNDS
23FOR 2013-2014
24Section 2001. General Fund repository for Federal funds.
25All moneys received from the Federal Government as
26contributions or supplements to the departments or agencies of
27the Commonwealth or the programs herein provided shall be paid
28into the General Fund.
29Section 2002. Limitation on encumbering or spending Federal
30funds.
1Federal funds shall be encumbered or spent only to the extent
2that such funds are estimated as being available during the
3fiscal year of the Commonwealth.
4Section 2003. Appropriation of prior unspent Federal funds.
5(a) General rule.--Any Federal money which has been
6previously appropriated by the General Assembly and authorized
7or allocated by the Federal Government but remains unspent from
8prior fiscal years and will not be renewed for fiscal year 2013-
92014 is hereby appropriated.
10(b) Department of Public Welfare.--The Federal
11appropriations to the Department of Public Welfare include any
12prior earnings that may be received during fiscal year 2013-
132014. In addition to the amounts specifically appropriated
14herein to the Department of Public Welfare, all moneys
15appropriated from the Federal Government during any previous
16fiscal year which are expected to be received as reimbursements
17may be carried forward until June 30, 2014, to the extent that
18obligations are carried forward. In addition, any reimbursements
19actually received to support such obligations may also be
20carried forward.
21Section 2004. Subgrants between Federal fund appropriations.
22Subgrants may be made between Federal appropriations without
23further approval of the General Assembly. The Secretary of the
24Budget shall submit a list of subgrants to the chairman and
25minority chairman of the Appropriations Committee of the Senate
26and the chairman and minority chairman of the Appropriations
27Committee of the House of Representatives quarterly. No subgrant
28to a State agency, however, may be made from a restricted
29receipt account without a specific appropriation by the General
30Assembly.
1Section 2005. Utilization of emergency Federal funds.
2(a) Natural disasters and civil disobedience.--Federal funds
3available for costs and damages resulting from natural disasters
4or civil disobedience may be added to an appropriation contained
5in this act or to funds appropriated or may be used for the
6purposes prescribed by the Federal Government.
7(b) Other emergencies.--In addition to the moneys
8appropriated by this act, all moneys received from the Federal
9Government for the purpose of disaster assistance or relief, or
10other moneys received as a direct result of terrorist acts,
11moneys for homeland security and defense and moneys for avian
12flu/pandemic preparedness shall be paid into the General Fund
13and are hereby appropriated out of the General Fund to the
14departments, boards, commissions or agencies designated by the
15Governor.
16(c) Executive authorization.--In the event of any emergency
17situation in which the General Assembly cannot act in sufficient
18time, the Governor is authorized through executive authorization
19to provide up to $10,000,000 in Federal funds to alleviate the
20emergency situation.
21(d) Definition.--For the purposes of this section,
22"emergency" is defined as any situation in which there is a
23chance of or which may result in substantial human suffering.
24Section 2006. Transfer of funds from TANFBG to CCDFBG and SSBG.
25In accordance with Federal law which permits the transfer of
26funds from the TANFBG to the CCDFBG and SSBG, the Department of
27Public Welfare, upon approval of the Secretary of the Budget,
28may make such transfers of funds provided that any such transfer
29will not result in a deficit in any appropriation from which
30funds are transferred. The Secretary of the Budget shall provide
1ten days prior notification of any such transfers to the
2chairman and the minority chairman of the Appropriations
3Committee of the Senate and the chairman and minority chairman
4of the Appropriations Committee of the House of Representatives.

10any provision of any act enacted at this or any prior session of
11the General Assembly regulating the purchase of supplies, the
12ordering of printing and binding, the purchase, maintenance and
13use of automobiles, the method of making payments from the State
14Treasury for any purpose or the functioning of any
15administrative department, board or commission.
16Section 2102. Compliance with other law before funds available.
17No appropriation made by this act to any department, board,
18commission or agency of the Executive Department shall be
19available unless and until the department, board, commission or
20agency has complied with sections 615 and 616 of the act of
21April 9, 1929 (P.L.177, No.175), known as The Administrative
22Code of 1929.
23Section 2103. Contracts prerequisite to encumbering or
24committing funds.
25Funds available to agencies, boards, departments, commissions
26or other governmental entities under this act for the
27procurement of supplies, services or construction shall not be
28available for payment of or to be committed to or encumbered for
29payment of any such procurement unless and until the agency,
30board, department or other governmental entity has complied with
1all of the requirements applicable to the procurement that are
2set out in 62 Pa.C.S. (relating to procurement) and in the
3policies, procedures and regulations instituted in accordance
4with that code.
5Section 2104. Minority business set-asides.

13Section 2106. Lapsing of unused funds.

15this section, that part of all appropriations in Parts II, III,
16IV, V, VI, VII, VIII, IX, X, XI, XII, XIII, XIV, XV, XVI, XVII,
17XVIII and XVIII-A unexpended, uncommitted or unencumbered as of
18June 30, 2014, shall automatically lapse as of that date.
19(b) Exceptions.--
20(1) The appropriations in Part II to the Pennsylvania
21Emergency Management Agency for Hazard Mitigation and for the
22Summer 2011 Storm Disaster Relief shall be continuing
23appropriations.
24(2) The appropriations in Part II to the State
25Government Support Agencies shall be continuing
26appropriations.
27(3) The appropriation in Part II to the Supreme Court
28for the unified judicial system security program shall be a
29continuing appropriation.
30(4) The appropriations in Part II to the General
1Assembly shall be continuing appropriations.
2Section 2107. Appellate courts appropriation contingency.
3The funds appropriated in Part II to the Supreme, Superior
4and Commonwealth Courts for justice and judge expenses are
5contingent upon a vouchered expense account plan being continued
6by the Supreme Court.
7Section 2108. Transfer of excess funds.
8The Governor may transfer any excess money in those funds
9receiving proceeds of Commonwealth of Pennsylvania general
10obligation bonds in excess of the amount necessary for the
11purposes for which the bonds were issued to the appropriate
12sinking fund for payment of debt service due on outstanding
13bonds. If such excess funds, together with any available
14balance, exceed the amount of debt service remaining to be paid,
15the funds shall be transferred to the General Fund or to the
16appropriate special fund responsible for such debt service.
17Section 2109. Transfers for government support agencies.
18During fiscal year 2013-2014, any prior year amount
19unexpended on the effective date of the General Appropriation
20Act of 2013 may, upon the written concurrence of the President
21pro tempore of the Senate, the Majority Leader of the Senate,
22the Speaker of the House of Representatives and the Majority
23Leader of the House of Representatives, be transferred between
24any of the following accounts:
25(1) Legislative Reference Bureau.
26(2) Legislative Budget and Finance Committee.
27(3) Legislative Data Processing Committee.
28(4) Joint State Government Commission.
29(5) Local Government Commission.
30(6) Legislative Audit Advisory Commission.
1(7) Center for Rural Pennsylvania.
2(8) Commonwealth Mail Processing Center.
3(9) Joint Legislative Air and Water Pollution Control
4and Conservation Committee.
5(10) Legislative Reapportionment Commission.
6(11) Independent Regulatory Review Commission.

10Section 2110. Transfer from Pennsylvania Race Horse Development
11Fund.
12The sum of $6,000,000 shall be transferred from the
13Pennsylvania Race Horse Development Fund to the State Farm
14Products Show Fund.

16EFFECTIVE DATE
17Section 2201. Effective date.
18This act shall take effect as follows:
19(1) Part XIX shall take effect immediately.
20(2) This section shall take effect immediately.
21(3) The remainder of this act shall take effect July 1,
222013, or immediately, whichever is later.
