AN ACT

 

1Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2Statutes, in preliminary provisions, further defining
3"emergency <-vehicle." vehicle"; and, in operation of vehicles, 
4further providing for drivers of emergency vehicles.

5The General Assembly of the Commonwealth of Pennsylvania
6hereby enacts as follows:

7Section 1. The definition of "emergency vehicle" in section
8102 of Title 75 of the Pennsylvania Consolidated Statutes,
9amended June 22, 2012 (P.L.642, No.67), is amended to read:

10§ 102. Definitions.

11Subject to additional definitions contained in subsequent
12provisions of this title which are applicable to specific
13provisions of this title, the following words and phrases when
14used in this title shall have, unless the context clearly
15indicates otherwise, the meanings given to them in this section:

17"Emergency vehicle." A county emergency management vehicle, 
18fire department vehicle, police vehicle, sheriff vehicle,

1ambulance, advanced life support squad vehicle, basic life 
2support squad vehicle, emergency canteen support service 
3organization vehicle, blood delivery vehicle, human organ
4delivery vehicle, hazardous material response vehicle, armed
5forces emergency vehicle, one vehicle operated by a coroner or
6chief county medical examiner and one vehicle operated by a
7chief deputy coroner or deputy chief county medical examiner
8used for answering emergency calls, a vehicle owned by or leased 
9to a regional emergency medical services council that is used as 
10authorized by the Department of Health to respond to an actual 
11or potential disaster, mass casualty situation or substantial 
12threat to public health, a vehicle owned by a county or regional 
13police association and operated by a police officer that is used 
14for police transport or victim extraction, a vehicle that is 
15owned and operated by a county correctional institution <-in a 
16city of the first class and used for the transport of <-to respond 
17to an emergency at a correctional institution in a city of the 
18first class or to escort an ambulance which is transporting sick 
19or injured prisoners in a city of the first class, any vehicle 
20operated by a special agent, special agent supervisor, narcotics 
21agent or narcotics agent supervisor while performing official 
22duties as employees of the Office of Attorney General, any
23vehicle owned and operated by the Philadelphia Parking Authority
24established in accordance with 53 Pa.C.S. Ch. 55 (relating to
25parking authorities) and used in the enforcement of 53 Pa.C.S. 
26Ch. 57 (relating to taxicabs and limousines in first class
27cities), <-a vehicle owned and operated by the Pennsylvania 
28Turnpike Commission that is used by an emergency service 
29responder as dispatched by the Pennsylvania Turnpike 
30Commission's traffic operations center, or any other vehicle

1designated by the State Police under section 6106 (relating to
2designation of emergency vehicles by Pennsylvania State Police),
3or a privately owned vehicle used in answering an emergency call
4when used by any of the following:

5(1) A police chief and assistant chief.

6(2) A fire chief, assistant chief and, when a fire
7company has three or more fire vehicles, a second or third
8assistant chief.

9(3) A fire police captain and fire police lieutenant.

10(4) An ambulance corps commander and assistant
11commander.

12(5) A river rescue commander and assistant commander.

13(6) A county emergency management coordinator.

14(7) A fire marshal.

15(8) A rescue service chief and assistant chief.

16(9) The chief or operations director of a county
17hazardous materials response team.

<-19Section 1.1. Section 3105 of Title 75 is amended by adding a
20subsection to read:

21§ 3105. Drivers of emergency vehicles.

23(d.1) Vehicles owned and operated by a county correctional
24institution in a city of the first class.--The driver of a
25vehicle that is owned and operated by a county correctional
26institution in a city of the first class and used to respond to
27an emergency at a correctional institution in a city of the
28first class or to escort an ambulance which is transporting a
29sick or injured prisoner in a city of the first class shall
30comply with maximum speed limits, red signal indications and

1stop signs. After ascertaining that the vehicle will be given
2the right-of-way, the driver may proceed through a red signal
3indication or stop sign.

5Section 2. This act shall take effect in 60 days.
