AN ACT

 

1Amending the act of April 9, 1929 (P.L.177, No.175), entitled
2"An act providing for and reorganizing the conduct of the
3executive and administrative work of the Commonwealth by the
4Executive Department thereof and the administrative
5departments, boards, commissions, and officers thereof,
6including the boards of trustees of State Normal Schools, or
7Teachers Colleges; abolishing, creating, reorganizing or
8authorizing the reorganization of certain administrative
9departments, boards, and commissions; defining the powers and
10duties of the Governor and other executive and administrative
11officers, and of the several administrative departments,
12boards, commissions, and officers; fixing the salaries of the
13Governor, Lieutenant Governor, and certain other executive
14and administrative officers; providing for the appointment of
15certain administrative officers, and of all deputies and
16other assistants and employes in certain departments, boards,
17and commissions; and prescribing the manner in which the
18number and compensation of the deputies and all other
19assistants and employes of certain departments, boards and
20commissions shall be determined," providing for the State
21Geospatial Coordinating Board.

22The General Assembly of the Commonwealth of Pennsylvania
23hereby enacts as follows:

24Section 1. The act of April 9, 1929 (P.L.177, No.175), known
25as The Administrative Code of 1929, is amended by adding a
26section to read:

1Section 432.1. State Geospatial Coordinating Board.--(a)
<-2The State Geospatial Coordinating Board shall be an advisory
3board within the Governor's Office with the same status under
4this act as that of other advisory boards. The <-There is
5established a State Geospatial Coordinating Board within the
6Governor's Office of Administration. The advisory board is
7established to provide advice and recommendations to the
8Governor and the citizens of this Commonwealth on geospatial
9issues, providing for uniformity, data standards, coordination
10and the efficiency of geospatial policy and technology issues
11among Federal, State and local government agencies, academic
12institutions and the private sector.

13(b) (1) The State Geospatial Coordinating Board shall
14consist of the following members:

15(i) The Secretary of Administration or a designee.

16(ii) The Secretary of Environmental Protection or a
17designee.

18(iii) The Secretary of Conservation and Natural Resources or
19a designee.

20(iv) The Director of the Pennsylvania Emergency Management
21Agency, or its successor agency, or a designee.

22(v) The Secretary of Transportation or a designee.

23(vi) The Secretary of General Services or a designee.

24(vii) One member designated by the President pro tempore of
25the Senate.

26(viii) One member designated by the Minority Leader of the
27Senate.

28(ix) One member designated by the Speaker of the House of
29Representatives.

30(x) One member designated by the Minority Leader of the

1House of Representatives.

2(xi) Three members appointed by the Governor as follows:

3(A) One member shall be a county commissioner at the time of
4appointment.

5(B) One member shall be a local elected official
6representing an urban or suburban Pennsylvania community.

7(C) One member shall be a local elected official
8representing a rural Pennsylvania community.

9(xii) One member designated by the County Geographic
10Information Systems Professionals Association of Pennsylvania.

11(xiii) One member designated by the Pennsylvania Mapping and
12Geographic Information Consortium.

13(xiv) One member designated by the County Commissioners
14Association of Pennsylvania.

15(xv) One member designated by the Pennsylvania Chapter of
16the Management Association for Private Photogrammetric
17Surveyors.

18(2) The members of the board shall include persons
19knowledgeable in the fields related to geographic information
20systems, such as geospatial technology, data development,
21architecture standards, data sharing, county government, local
22government, municipal planning <-and or municipal authorities. The
23appointees shall serve at the pleasure of the appointing
24authority.

25(c) The board shall also include the following nonvoting ex
26officio members or their designees, who shall have all the
27rights of other members, except for voting:

28(1) The Commonwealth's mapping liaison from the United
29States Geological Survey.

30(2) One member designated by the Pennsylvania One Call

1System.

2(3) The chairman of the Pennsylvania Public Utility
3Commission or a designee.

4(4) One member designated by the Pennsylvania Society of
5Land Surveyors.

6(5) One member designated by The Geographic Information
7System Consortium of the Pennsylvania State System of Higher
8Education.

9(6) One member designated by the Pennsylvania Municipal
10Authorities Association.

11(7) One member designated by the American Planning
12Association, Pennsylvania Chapter.

13(8) The <-executive director of Pennsylvania Spatial Data
14Access.

15(d) The terms of office of members representing State
16agencies shall coincide with the term of the Governor. In case
17of a vacancy, the Governor shall make an appointment for the
18unexpired portion of the term. An organizational designee shall
19serve a term of three years. In the case of a vacancy, the
20appropriate organization shall provide a designee for the
21unexpired portion of the term. <-The replacement council member 
22shall serve until an alternate designee is duly appointed by the 
23appropriate organization for the following term.

24(e) The Governor shall designate the chairperson and vice-
25chairperson of the board from among the members of the board,
26other than the ex officio and legislative members. The board
27shall meet not less than four times yearly. Additional meetings
28shall be at the discretion of the chairperson. Nine members of
29the board shall constitute a quorum.

30(f) The members of the board shall serve without

1compensation <-but shall be entitled to receive travel and other
2reasonable expenses incurred in the discharge of their duties.
3The board may, with the approval of the Governor, appoint and
4fix the compensation of an executive director who shall be
5technically qualified for the duties of the office and who shall
6act as secretary of the board and conduct the work of the board
7under its supervision.

8(g) The board shall have the power to employ and fix the
9compensation of such experts, stenographers and assistants as
10may be deemed necessary to carry out the work on the board, but
11due diligence shall be exercised by the board to enlist such
12voluntary assistance as may be available from citizens, research
13organizations and other agencies in this Commonwealth or
14elsewhere, generally recognized as qualified to aid the board.

15(h) The board shall have the following powers and duties:

16(1) Recommend data development priorities and
17interoperability standards for data sharing across agencies and
18different units of government across this Commonwealth.

19(2) Monitor national and State trends, identify issues of 
20potential interest and concern to the Commonwealth and prepare 
21for the Governor and the General Assembly on an annual basis, or 
22more often if necessary, reports detailing the findings of the 
23board.

24(3) Define and prioritize strategic opportunities where maps
25and spatial analysis activities could enhance the business of
26government and provide more cost-effective services to citizens.
27This paragraph may include recommendations of specific
28geospatial technology investments in this Commonwealth.

29(4) Develop task forces as needed to formulate recommended
30positions or actions. The task force membership may be comprised

1of board members or designees appointed by the board. The board
2shall consider any task force recommendations at its next
3meeting.

4(i) The Office of Administration shall provide
5administrative assistance to <-the council as requested by the
6chairperson of the board.

7(j) Commonwealth agencies may provide assistance to the
8board upon request of the chairperson, if sufficient
9Commonwealth resources exist. <-the board and may provide other
10assistance to the board upon recommendation of the chairperson,
11if sufficient Commonwealth resources exist.

<-12(k) (j) This section shall expire on June 30, 2020.

13Section 2. This act shall take effect in 60 days.
