AN ACT
1Authorizing the release of all restrictions imposed by the
2Project 70 Act on <-a portion of certain lands situated in the
3Borough of Brentwood, Allegheny County, in exchange for the
4imposition of Project 70 restrictions on other lands owned by
5the Borough of Brentwood, Allegheny County.
6The General Assembly of the Commonwealth of Pennsylvania
7hereby enacts as follows:
8Section 1. Authorization.
9Under the requirements of section 20(b) of the act of June
1022, 1964 (Sp.Sess., P.L.131, No.8), known as the Project 70 Land
11Acquisition and Borrowing Act, the General Assembly hereby
12authorizes the release of Project 70 restrictions from the lands
13described in section 2 <-in exchange for imposition of Project 70
14restrictions on the lands described in section 3..<- Project 70
15restrictions remain on the remainder of the land also described
16in section 2. In exchange for the portion released from Project
1770 restrictions, Project 70 restrictions will be imposed on the
18lands described in section 3.
19Section 2. <-Lands to be released from Project 70 restrictions.
<-1Portion of lands to be released from Project 70 restrictions and
2portion to continue to be Project 70 protected.
<-3The A portion of the property of the Borough of Brentwood to
4be released from Project 70 restrictions is as follows:
5ALL that certain lot or piece of ground situate in the
6Borough of Brentwood, County of Allegheny and Commonwealth of
7Pennsylvania, being more particularly bounded and described as
8follows, to-wit:
9BEGINNING at a point in the northeasterly side of East
10Willock Road (40) feet wide), said point <-being beginning on the
11line dividing lands herein described and lands now or <-late
<-12formerly of L. J. Ackman; thence the following courses and
13distances along the line dividing lands herein described and
14lands of said L. J. Ackman.
15N 52º 42' 00" E 86.23 feet to a point;
16N 59º 58' 00" E 197.36 feet to a point;
17N 64º 00' 00" E 300.84 feet to a point;
18thence along the line dividing lands herein described and <-Lot
19Nos. 24 to 28 inclusive in the Prospect Park Plan of Lots No. 2,
20as said plan is recorded in Plan Book Volume 41, pages 75, 76
21and 77, N 68º 39' 00" E 276.12 feet to a point; thence along the
22line dividing lands herein described and lands now or late of
23Prospect Terrace, Inc., N 63º 20' 00" E 382.93 feet to a point;
24thence along the line dividing lands herein described and lands
25now or late or John E. Lehman N 35º 44' 00" W 486.09 feet to a
26point in the centerline of a Borough Road known as Wanley Road;
27thence the following courses and distances along the centerline
28of Wanley Road:
29S 49º 08' 00" W 155.76 feet to a point;
30S 31º 20' 00" W 80.69 feet to a point;
1S 52º 53' 00" W 96.30 feet to a point;
2S 54º 24' 00" W 116.90 feet to a point;
3S 52º 02' 00" W 275.60 feet to a point;
4S 58º 28' 00" W 98.80 feet to a point;
5S 61º 11' 00" W 236.00 feet to a point;
6S 51º 58' 00" W 160.60 feet to a point in the centerline of
7the above mentioned Wanley Road; thence leaving Wanley Road and
8along the line dividing lands now or late of Mike Passero, lands
9herein described and extending along the northeasterly right-of-
10way line of West Willock Road S 32º 50' 00" E a distance of
11260.82 feet to the point of beginning.
12Containing a total area of 9.36 acres, more or less.
<-13the land now or formerly of the Borough of Brentwood N 35º 44'
1400" W 303.56 feet to a point in the center of a Borough Road
15known as Wanley Road; thence along the following courses and
16distances along the centerline of Wanley Road:

19S 61º 11' 00" W a distance of 236.00 feet to a point;
20S 51º 58' 00" W a distance of 160.60 feet to a point in the
21centerline of above mentioned Wanley Road; thence leaving Wanley
22Road and along the line dividing lands now or formerly of Mike
23Passero, lands herein described and extending along the
24northeasterly right-of-way line West Willock Road S 32º 50' 00"
25E a distance of 260.82 feet to a point of beginning.
26Containing a total area of 3.68 acres, more or less.
27The remaining portion of the property of the Borough of
28Brentwood continues to be protected with Project 70 restrictions
29as follows:
30All that certain lot or piece of ground, situate in the
1Borough of Brentwood, County of Allegheny and Commonwealth of
2Pennsylvania, more particularly bound and described as follows:
3BEGINNING at a point in the northeasterly side of Lots Nos.
424 to 28 inclusive in the Prospect Park Plan of Lots No. 2, and
5said plan is recorded in Plan Book volume 41, pages 75, 76 and
677, N 68º 39' 00" E 276.12 feet to a point; thence along the
7line dividing lands herein described and lands now or late of
8Prospect Terrace, Inc., N 63º 20' 00" E 382.93 feet to a point;
9thence along the line dividing lands herein and lands now or
10late of John E. Lehman N 35º 44' 00" W 486.09 feet to a point in
11the centerline of a Borough Road known as Wanley Road; thence
12the following courses and distances along the centerline of
13Wanley Road:
14S 49º 08' 00" W 155.76 feet to a point;
15S 31º 20' 00" W 80.69 feet to a point;
16S 52º 53' 00" W 96.30 feet to a point;
17S 54º 24' 00" W 116.90 feet to a point;
18S 52º 02' 00" W 187.89 feet to a point;
19S 35º 44' 00" W 303.56 feet to a point of beginning.
20Containing total area of 5.62 acres, more or less.
21BEING the same property which Hugh Fishwick, Jr., Et Ux
22granted and conveyed unto Edward J. Ratcliffe, one of the
23grantors herein, by deed recorded in Deed Book Volume 2897, page
24554 in the Recorder of Deeds Office of Allegheny County,
25Pennsylvania.
26ALSO BEING the same property which Hugh Fishwick, Jr. Et ux
27by the deed dated July 21, 1947 and recorded in Deed Book Bolume<-
28Volume<- 3045, Page 487, in the Recorder of Deeds Office of
29Allegheny County, Pennsylvania.
30BEING designated in the Deed Registry Office of Allegheny
1County as Block No. 188-M, Lot No. 55.
2Section 3. Lands owned by Borough of Brentwood on which Project
370 restrictions are to be imposed.
4The property of the Borough of Brentwood on which Project 70
5restrictions are to be imposed is as follows:
6ALL that unimproved piece of ground situate in the Borough of
7Brentwood, County of Allegheny and Commonwealth of Pennsylvania,
8consisting of approximately 8.5 acres of ground, being more
9fully described as follows:
10BEGINNING at a point on the westerly side of Elton Way, 20
11feet wide, as shown on the Hilpert Place Plan recorded in the
12Recorder of Deeds Office of Allegheny County in Plan Book Volume
1330, pages 132 and 133, at the line dividing lands now or
14formerly of Thomas Gabrielli from lands herein described, said
15point being distant along the westerly side of said Elton Way S
1632º 41' 25" East 170.04 feet from the center line of Hilpert
17Street, 40 feet wide, as shown on said plan where it intersects
18with the westerly side of said Elton Way:
19THENCE, from said point of beginning and along the westerly
20side of said Elton Way South 32º 41' 25" East a distance of
21539.82 feet to a point in East Willock Way, 50 feet wide, at the
22corner common to lands now or formerly of Adam Young and land
23herein described; thence along the line of lands of Young North

9feet wide; thence along the easterly right-of-way of Brednick

11feet to a point; thence by an arc of a circle curving to the
12right having a radius of 20.00 feet for an arc distance of 38.07
13feet to a point on the southerly right-of-way line of
14Meadowbrook Boulevard 40 feet wide; thence along the same North

16of land of now or formerly of Thomas Gabrielli; thence along

21the southerly right-of-way line of Meadowbrook Boulevard
22aforesaid; thence by the same by an arc of a circle curving to
23the right having a radius of 1,480.00 feet for an arc distance
24of 13.12 feet to a point on the line of said Thomas Gabrielli;
25thence along the line of Gabrielli South 58º 53' 15" East a
26distance of 9.45 feet to a point; thence by the same North 74º
2729' 29" East a distance of 39.22 feet to a point; thence by the
28same North 41º 05' 04" East a distance of 26.44 feet to a point
29on the southerly right-of-way line of Meadowbrook Boulevard 40
30feet wide; thence along the southerly side of said Boulevard by
1an arc of a circle curving to the right and having a radius of
21,480.00 feet for an arc distance of 47.72 feet to a point at
3the northerly terminus of said Boulevard; thence along the
4northerly terminus of said Boulevard North 18º 48' 49" West a
5distance of 26.89 feet to a point on line of land now or
6formerly of Thomas Gabrielli; thence along the line of said
7Gabrielli North 41º 05' 04" East a distance of 168.42 feet to a
8point; thence by the same North 69º 25' 04" East a distance
9119.38 feet to a point; thence by the same North 86º 33' 55"
10East a distance of 157.00 feet to a point at the place of
11beginning.
12BEING the same Property which was conveyed by James C.
13Lorenzi and Lisa K. Lorenzi, husband and wife, to Western
14Pennsylvania Conservancy and recorded on December 30, 2003 in
15the Recorder of Deeds Office, Deed Book 11904, Page 117,
16Allegheny County, Pennsylvania. This property is assessed in the
17municipality of Brentwood as tax identification number 188-R-
18150.
19Section 4. Restriction.
20Project 70 restrictions shall be imposed on the lands
21described in section 3 by the following deed clause:
22This land is to be used for park, recreation and
23conservation purposes in accordance with provisions of
24the act of June 22, 1964 (Sp.Sess., P.L.131, No.8), known
25as the Project 70 Land Acquisition and Borrowing Act.
26Section 5. Effective date.
27This act shall take effect immediately.
