AN ACT

 

1Amending Title 42 (Judiciary and Judicial Procedure) of the
2Pennsylvania Consolidated Statutes, further providing for
3municipal corporation portion of fines.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. Section 3573 of Title 42 of the Pennsylvania
7Consolidated Statutes is amended by adding a subsection to read:

8§ 3573. Municipal corporation portion of fines, etc.

10(c.1) Police services.--

11(1) A municipal corporation shall be reimbursed for
12eligible police services performed by the police department
13of the municipal corporation by individuals who are convicted
14of and sentenced for a felony.

15(2) Rate of reimbursement for eligible police services
16shall be set as follows:

17(i) Actual mileage for travel by motor vehicle shall
18be reimbursed at a rate equal to the highest rate allowed

1by the Internal Revenue Service. If travel is by other
2than motor vehicle, reimbursement shall be for actual
3vouchered travel expenses. If more than one defendant is
4transported simultaneously, reimbursements shall be for
5actual miles traveled, and the travel cost shall be
6divided between or among the defendants who are convicted
7and sentenced.

8(ii) Actual time for which the defendant is in
9custody under the authority of the police department and
10for attending an arraignment or court hearing for an
11official purpose related to the prosecution of the
12defendant shall be reimbursed at a rate of $13 per hour.
13If more than one defendant is in custody for the same
14incident simultaneously or if attendance is required at
15an arraignment or court hearing for an official purpose
16related to the prosecution of more than one defendant
17simultaneously, reimbursements shall be for actual time,
18and the cost shall be divided between or among the
19defendants who are convicted and sentenced.

20(3) As used in this section, "eligible police services"
21shall mean time and mileage associated with:

22(i) Taking a defendant into custody.

23(ii) Transporting a defendant from where the
24defendant is taken into custody to where the defendant is
25transferred to another authority or released.

26(iii) Attending an arraignment or court hearing for
27an official purpose related to the prosecution of the
28defendant.

30Section 2. This act shall take effect in 60 days.
