AN ACT

 

1Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
2act relating to the public school system, including certain
3provisions applicable as well to private and parochial
4schools; amending, revising, consolidating and changing the
5laws relating thereto," providing for certain furloughed
6professional employees and temporary professional employees.

7The General Assembly of the Commonwealth of Pennsylvania
8hereby enacts as follows:

9Section 1. The act of March 10, 1949 (P.L.30, No.14), known
10as the Public School Code of 1949, is amended by adding a
11section to read:

12Section 925-A. Certain Furloughed Professional Employes and
13Temporary Professional Employes.--(a) When the Commonwealth
14terminates a contract with an intermediate unit for services
15conducted at a Department of Public Welfare operated facility
16for adjudicated delinquent youth, the Department of Education
17shall create a pool of professional employes and temporary
18professional employes furloughed as a result of the termination.

19(b) For the three years immediately following the formal
20notice of a contract termination from the Commonwealth, employes

1in a pool created under subsection (a) shall be offered
2employment by each eligible school district when that eligible
3school district has a vacancy for a position that an employe in
4the applicable pool is properly certified to fill, provided that
5no professional employe or temporary professional employe of the
6eligible school district in which the vacancy exists, including
7a suspended employe, has a right to the vacancy under the
8collective bargaining agreement of the eligible school district
9or section 1125.1.

10(c) For the three years immediately following the formal
11notice of a contract termination from the Commonwealth, no new
12professional employe or temporary professional employe may be
13hired by an eligible school district associated with the
14applicable pool created under subsection (a), until the position
15has been offered, in order of seniority, to all properly
16certified professional employes and temporary professional
17employes of the applicable pool created under subsection (a).

18(d) The following terms, whenever used or referred to in
19this section, shall have the following meanings, except in those
20circumstances where the context clearly indicates otherwise:

21"Eligible school district" means a school district that is
22assigned to an intermediate unit, pursuant to section 902-A or a
23subsequent transfer under section 903-A, for which a
24Commonwealth contract has been terminated.

25Section 2. This act shall take effect immediately.
