AN ACT

 

1Authorizing the release of Project 70 restrictions on certain
2Project 70 land situate in Piney Creek Springs, Woodbury
3Township, Blair County, owned by the Commonwealth in return
4for the imposition of Project 70 restrictions on certain land
5situate in Woodbury Township, Blair County, being conveyed to
6the Pennsylvania Fish and Boat Commission.

7The General Assembly of the Commonwealth of Pennsylvania
8hereby enacts as follows:

9Section 1. Release of restrictions in Piney Creek Springs, 
10Woodbury Township, Blair County.

11(a) Authorization.--Pursuant to the requirements of section
1220(b) of the act of June 22, 1964 (Sp.Sess., P.L.131, No.8),
13known as the Project 70 Land Acquisition and Borrowing Act, the
14General Assembly hereby authorizes the release of Project 70
15restrictions on a portion of lands owned by the Pennsylvania
16Fish and Boat Commission that are described in subsection (b),
17in return for the imposition of Project 70 restrictions on land
18described in subsection (c) that is being conveyed to the
19commission.

20(b) Land to be released from restrictions.--The parcel of

1land to be released from Project 70 restrictions is located in
2Woodbury Township, Blair County, and more particularly described
3as follows:

4All that certain piece or parcel of land situate in Woodbury
5Township, County of Blair, Commonwealth of Pennsylvania more
6particularly described as a portion of the lands conveyed to
7Commonwealth of Pennsylvania acting by and through the
8Pennsylvania Fish and Boat Commission in the deed found in Blair
9County Deed Book 1221, Page 178, currently called Tax Parcel 40
10on Blair County Tax Map 24-11 (Parent Tract), northwest of State
11Route 866 more particularly described as follows:

12COMMENCING at the centerline of the intersection of State Route
13866 and State Route 2020 (Royer Mountain Road) thence running in
14a southwesterly direction along the centerline of State Route
15866 a distance of approximately 730 feet to a point opposite an
16iron pin set in the western right of way for State Route 866,
17and being the Point of Beginning,

18BEGINNING at the Point of Beginning, Thence along the western
19right of way line for State Route 866, South 21° 17' 03" West, a
20distance of 54.46 feet to an iron pin set in the western right
21of way for State Route 866; Thence leaving the western right of
22way for State Route 866, along a new line through the above
23mentioned Commonwealth property, the following twelve (12)
24courses and distances:

251. North 45° 22' 13" West, a distance of 657.83 feet to an iron
26pin set;

272. South 44° 37' 45" West, a distance of 193.00 feet to an iron
28pin set;

293. North 45° 22' 13" West, a distance of 249.86 feet to an iron
30pin set;

14. North 22° 39' 27" East, a distance of 405.29 feet to an iron
2pin set;

35. North 07° 39' 54" West, a distance of 132.43 feet to an iron
4pin set;

56. North 21° 31' 24" East, a distance of 77.77 feet to an iron
6pin set;

77. South 87° 25' 39" East, a distance of 163.74 feet to an iron
8pin set;

98. South 25° 32' 25" East, a distance of 168.63 feet to an iron
10pin set;

119. South 20° 06' 46" East, a distance of 169.73 feet to an iron

1310. South 15° 13' 48" West, a distance of 210.00 feet to an

21(c)  Land on which restrictions are to be imposed.--The
22parcel of land on which Project 70 restrictions are to be
23imposed is located in Woodbury Township, Blair County and more
24particularly described as follows:

25All that certain piece or parcel of land situate in Woodbury
26Township, County of Blair, Commonwealth of Pennsylvania more
27particularly described as a portion of the lands conveyed to
28Steven and Angela Lynn in the deed found in Blair County Deed
29Book 1512, Page 566, currently called Tax Parcel 12 on Blair
30County Tax Map 21-11 (Parent Tract), southeast of the centerline

1of Township Road 378 more particularly described as follows:

2BEGINNING at a railroad spike set at the intersection of the
3centerline of Woodbury Township Road 378 and the northeastern
4property line of the Parent Tract, being a common line with
5lands now or formerly of Robert L. Gorsuch as recorded in Blair
6County Recorder's Office in Deed Book 1175 Page 644, said
7railroad spike being the northern most point of the herein
8described parcel and being the Point of Beginning;

9Thence from the Point of Beginning, along the said lands of
10Gorsuch, crossing Piney Creek, South 52° 11' 55" East, a
11distance of 192.31 feet to an iron pin set in the centerline of
12the old railroad bed of the Pennsylvania Railroad; Thence along
13the centerline of the old railroad bed and along lands now or
14formerly of Melvin Burkholder as recorded in the Blair County
15Recorder's Office in Deed Book 1276 Page 512, the following 5
16(five) courses and distances:

171. South 37° 38' 34" West, a distance of 139.05 feet to a point

182. South 24° 37' 41" West, a distance of 123.28 feet to a point

193. South 17° 05' 10" West, a distance of 93.63 feet to a point

215. South 21° 01' 08" West, a distance of 180.90 feet to a point
22in the centerline of the old railroad bed of the Pennsylvania
23Railroad;

24Thence diverging from the centerline of the old railroad bed and
25continuing along lands of said Burkholder, South 50° 00' 39"
26West, a distance of 994.86 feet to a point; Thence along lands
27now or formerly of Harold Evans, South 54° 00' 00" West, a
28distance of 396.00 feet to an existing iron pin; Thence
29continuing along lands of said Evans, crossing Piney Creek North
3031° 47' 19" West, a distance of 112.14 feet to an existing

1railroad spike found in the center of Township Road 378; Thence
2along the centerline of Township Road 378 the following

29(d)  Final area and configuration.--Final area and 
30configuration of the land described under subsections (b) and 

1(c) are subject to local zoning and subdivision requirements.

2(e) Deed restriction.--The restriction to be included in the
3deed of conveyance for the parcel described in subsection (c)
4shall be as follows:

5This indenture is given to provide land for recreation,
6conservation and historical purposes, as said purposes are
7defined in the act of June 22, 1964 (Sp.Sess., P.L.131, No.8),
8known as the Project 70 Land Acquisition and Borrowing Act.

9Section 2. Effective date.

10This act shall take effect immediately.
