AN ACT
1Amending Title 75 of the Pennsylvania Consolidated Statutes,
2further providing for fleeing or attempting to elude police
3officer.
4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:
6Section 1. Section 3733(a) and (a.2)(2)(iii) of the
7Pennsylvania Consolidated Statutes are amended to read:
8§ 3733. Fleeing or attempting to elude police officer.
9(a) Offense defined.--Any driver of a motor vehicle who
10willfully fails or refuses to bring his vehicle to a stop, or
11having stopped, fails to remain in or at his vehicle, or who
12otherwise flees or attempts to elude a pursuing police officer,
13when given a visual and audible signal to bring the vehicle to a
14stop, commits an offense as graded in subsection (a.2).

16(a.2) Grading.--

1(2) An offense under subsection (a) constitutes a felony
2of the third degree if the driver while fleeing or attempting
3to elude a police officer does any of the following:

5(iii) endangers a law enforcement officer or member
6of the general public due to the driver engaging in a
7high-speed chase or by an action in violation of this
8section, creates a risk of injury to anyone.

10Section 2. This act shall take effect in 60 days.
